McDuffie 2 3 4 5 6 A PROPOSED RESOLUTION 7 _________________ 8 9 IN THE COUNCIL OF THE DISTRICT OF COLUMBIA 10 _________________________ 11 12 To declare the existence of an emergency with respect to the need to define the terms 13 non-District resident and another jurisdiction, and to provide the Alcoholic 14 Beverage and Cannabis Board with the authority to issue patient and caregiver 15 registration cards at no cost. 16 17 RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That 18 this resolution may be cited as the “Medical Cannabis Patient Access Clarification 19 Emergency Declaration Resolution of 2024”. 20 Sec. 2. (a) There existed an immediate need to define the terms non-District 21 resident and another jurisdiction, and to provide the Alcoholic Beverage and Cannabis 22 Board with the authority to issue patient and caregiver registration cards at no cost. 23 (b) In October 2023, the Council enacted legislation to address the above-24 mentioned issues. The temporary, the Medical Cannabis Patient Access Clarification 25 Temporary Amendment Act of 2023, effective January 23, 2024 (D.C. Law 25-103; 71 26 DCR 1651) (“temporary act”), expires on September 4, 2024. 27 (c) Comprehensive permanent legislation addressing these issues has been 28 introduced but must complete the legislative process. 29 (d) It is of vital importance that the provisions of the temporary act continue in 30 effect until the permanent legislation has become law. 31 2 Sec. 3. The Council determines that the circumstances enumerated in section 2 32 constitute emergency circumstances making it necessary that the Medical Cannabis 33 Patient Access Clarification Emergency Amendment Act of 2024 be adopted after a single 34 reading. 35 Sec. 4. This resolution shall take effect immediately. 36
