Wilson Building 1350 Pennsylvania Avenue, NW Washington, DC 20004 Dear Chairman Mendelson: Enclosed for consideration and approval by the Council of the District of Columbia is a proposed emergency resolution entitled “Corrected Compensation and Working Conditions Agreement between the District of Columbia Public Schools and the Washington Teachers’ Union, Local #6 of the American Federation of Teachers Emergency Approval Resolution of 2024”, along with an accompanying emergency declaration resolution. This legislation will correct a drafting error in the version of the collective bargaining agreement between the District of Columbia Public Schools (DCPS) and the Washington Teachers’ Union (WTU) that was approved by the Council pursuant to the Compensation and Working Conditions Agreement between the District of Columbia Public Schools and the Washington Teachers’ Union, Local #6 of the American Federation of Teachers Approval Resolution of 2023, effective February 7, 2023 (Res. 25-53; 70 DCR 2159). Specifically, section 36.10.2 of the Council-approved agreement stated that “[t]he Parties agree to discuss additional compensation options for elementary Grade Level Chairs.” However, DCPS and WTU had already agreed at that time that DCPS would provide a new stipend of $1,000 per year for elementary grade chairs starting in school year 2022 through 2023.” The updated stipend provision, however, was not included in the version of the agreement submitted to the Council. The enclosed legislation therefore provides for the Council’s approval of the corrected version of the agreement, with a revised section 36.10.2 that states that “[a]ll elementary Grade Level Chairs shall receive an annual non-pensionable stipend at $1,000 starting in the 2022-2023 school year,” which will allow the agreement to take effect with the agreed-upon stipend for elementary Grade Level Chairs. This is the only difference from the v ersion of the agreement that was previously transmitted to and approved by the Council. RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this resolution may be cited as the "Corrected Compensation and Working Conditions Agreement between the District of Columbia Public Schools and the Washington Teachers' Union, Local #6 of the American Federation of Teachers Emergency Declaration Resolution of 2024". Sec. 2. (a) There exists an immediate need to approve a corrected version of the negotiated compensation agreement previously submitted by the Mayor and approved by the Council for employees of the District of Columbia Public Schools ("DCPS") who are represented by the Washington Teachers' Union, Local #6 ("WTU"). (b) The District of Columbia negotiated a compensation and working conditions agreement ("negotiated agreement") for certain DCPS employees that was approved by the Council on February 7, 2023, through the Compensation and Working Conditions Agreement between the District of Columbia Public Schools and the Washington Teachers' Union, Local #6 1 2 of the American Federation of Teachers Approval Resolution of 2023, effective February 7, 34 2023 (Res. 25-53; 70 DCR 2159). 35 (c) The version of the agreement transmitted to and approved by the Council included a 36 drafting error. Specifically, section 36.10.2 of that version of the agreement stated that “[t]he 37 Parties agree to discuss additional compensation options for elementary Grade Level Chairs.” 38 However, DCPS and WTU had already agreed at that time that DCPS would provide a new 39 stipend of $1,000 per year for elementary grade chairs starting in school year 2022 through 40 2023.” The updated stipend provision, however, was not included in the version of the 41 agreement submitted to the Council. 42 (d) To effectuate the intent and agreement of DCPS and WTU regarding the stipends, a 43 corrected version of the agreement, with a section 36.10.2 that states that “[a]ll elementary Grade 44 Level Chairs shall receive an annual non-pensionable stipend at $1,000 starting in the 2022-2023 45 school year” must be approved by the Council. 46 (f) Failure to immediately approve the corrected version of the agreement may result in 47 undermining the confidence of union members in the District of Columbia government and may 48 jeopardize the future relationship between labor and management in the District of Columbia 49 Sec. 3. The Council determines that the circumstances enumerated in section 2 constitute 50 emergency circumstances making it necessary that the Corrected Compensation and Working 51 Conditions Agreement between the District of Columbia Public Schools and the Washington 52 Teachers’ Union, Local #6 of the American Federation of Teachers Emergency Approval 53 Resolution of 2024 be adopted on an emergency basis. 54 Sec. 4. This resolution shall take effect immediately. 55
