1 1 ________________________________ 2 Councilmember Charles Allen 3 4 5 6 A PROPOSED RESOLUTION 7 8 _______ 9 10 IN THE COUNCIL OF THE DISTRICT OF COLUMBIA 11 12 ________________ 13 14 15 To declare the existence of an emergency with respect to the need to confirm the appointment of 16 Sharon Kershbaum as the Director of the District Department of Transportation. 17 18 RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this 19 resolution may be cited as the “Director of the District Department of Transportation Sharon 20 Kershbaum Confirmation Emergency Declaration Resolution of 2024”. 21 Sec. 2. (a) By law, the District Department of Transportation (“DDOT”) must be led by a 22 Director that is appointed by the Mayor and confirmed by the Council. After the departure of 23 former DDOT Director Everett Lott in October 2023, Sharon Kershbaum has served as the 24 agency’s Interim, and now Acting, Director. 25 (b) On April 10, 2024, Chairman Mendelson introduced PR25-0723, the Director of the 26 District Department of Transportation Sharon Kershbaum Confirmation Resolution of 2024, at the 27 request of the Mayor. PR25-0723 would confirm Acting Director Kershbaum’s appointment as the 28 permanent Director for the District Department of Transportation. PR25-0723 is deemed approved 29 on September 22, 2024. 30 2 (c) PR25-0723 was referred to the Committee on Transportation and the Environment on 31 April 23, 2024 and the Committee held a public roundtable on the measure on June 20, 2024. 32 Although the Committee voted to approve PR25-0723 at its September 16, 2024 Additional 33 Meeting, the Committee will not have filed its report in time for the Council to consider the 34 measure at the September 17, 2024 Legislative Meeting. 35 (d) If the Council does not vote on Acting Director Kershbaum’s nomination at the 36 September 17, 2024 legislative meeting, PR25-0723 will be deemed approved without the Council 37 affirmatively acting on her nomination. Given the important role that the Director of the District 38 Department of Transportation plays in overseeing the design and construction of transportation 39 projects, building safer streets, and transforming public spaces for the community to enjoy, the full 40 Council should have an opportunity to consider and vote on Ms. Kershbaum’s nomination. 41 Sec. 3. The Council determines that the circumstances enumerated in section 2 constitute 42 emergency circumstances making it necessary that the Director of the District Department of 43 Transportation Sharon Kershbaum Confirmation Emergency Approval Resolution of 2024 be 44 adopted on an emergency basis. 45 Sec. 4. This resolution shall take effect immediately. 46
