1 1 Chairman Phil Mendelson 2 3 4 5 6 7 A PROPOSED RESOLUTION 8 9 10 11 IN THE COUNCIL OF THE DISTRICT OF COLUMBIA 12 13 14 15 To declare the existence of an emergency, due to congressional review, with respect to the need 16 to amend Chapter 39 of Title 28 of the District of Columbia Official Code to clarify that 17 the District government is not a merchant under the District’s consumer protection law, 18 except with respect to the application of that chapter’s landlord-tenant relations 19 provisions to the District of Columbia Housing Authority. 20 21 RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this 22 resolution may be cited as the “Consumer Protection Clarification Congressional Review 23 Emergency Declaration Resolution of 2025”. 24 Sec. 2. (a) On November 26, 2024, the Council unanimously approved the Consumer 25 Protection Clarification Emergency Amendment Act of 2024 (D.C. Act 25-667; 71 DCR 26 16306)(“emergency measure”). The emergency measure will expire on March 19, 2025. 27 (b) On December 17, 2024, the Council unanimously approved the Consumer Protection 28 Clarification Temporary Amendment Act of 2024 (D.C. Act 25-707)(“temporary measure”) on 29 second reading. The temporary measure has yet to complete congressional review. Therefore, 30 this congressional review emergency is necessary to prevent a gap in the law between the 31 expiration of the emergency measure and the effective date of the temporary measure. 32 2 Sec. 3. The Council determines that the circumstances enumerated in section 2 constitute 33 emergency circumstances making it necessary that the Consumer Protection Clarification 34 Congressional Review Emergency Act of 2025 be adopted after a single reading. 35 Sec. 4. This resolution shall take effect immediately. 36
