AN ACT MAKING A ONE-TIME SUPPLEMENTAL APPROPRIATION FOR THE FISCAL YEAR ENDING 
JUNE 30, 2024 TO THE OFFICE OF MANAGEMENT AND BUDGET . 
 
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Three-fourths of all 
members elected to each house thereof concurring therein):     
 
 Section 1. There is hereby appropriated 	$194,560,278 (One Hundred Ninety-Four Million, Five Hundred 1 
Sixty Thousand, Two Hundred Seventy-Eight Dollars) in General Funds to the Office of Management and 2

 Section 2. The funding by the State of Delaware of 27 pay periods in Fiscal Year 2024 does not obligate 71 
the local school districts for the payment of the local share of employee’s salaries for a 27th pay period. The local 72 
school districts’ Board of Education will independently address the funding of the 27 pay periods in the Fiscal 73 
Year 2024. The first pay date for the school year 2023-	2024 for 10-month employees will be the second pay date 74 
in September (9/22/2023). Employees who elect 22 pay cycles will be paid the same amount of annual salary as if 75 
they had elected to be paid over 26 pay cycles. This section applies only to those staff members that are employed 76   Page 4 of 6

for the entire 2022-	2023 school year. Those employees that begin employment or end employment during the 77 
course of the 2022- 2023 school year shall be subject to a ‘days worked’ calculation and shall not be entitled to the 78 
27th pay. 79 
Section 3. Section 1 of this Act makes an appropriation to the Office of Management and Budget, One-80 
Times and Contingencies (10-	02-11) of $3,000,000 in Education Salary Supplement Contingency . These funds 81 
shall be used as one-time support for local education agencies (LEAs) to ensure that all education employees 82 
receive the Fiscal Year 2024 salary supplement for non-administrator public education employees paid pursuant 83 
to 14. Del. C. §1305, in addition to the general salary increase provided to all state employees, regardless of 84 
funding source.  85 
(a) The Office of Management and Budget, in collaboration with the Department of Education 86 
shall establish the process, collection, and criteria for LEAs to identify the affected positions 87 
fully funded with local and/or federal funds and the anticipated funding needs to ensure the 88 
salary supplement is provided for positions.  89 
(b) Employees paid pursuant to 14 Del. C. §1305 who also receive a salary supplement for 90 
administrative responsibilities pursuant to 14 Del. C. §1306, §1307, and §1321 shall not be 91 
eligible to receive the salary supplement. 92 
(c) The supplement shall be effective the first day of the first full pay cycle of the fiscal year. 93 
(d) The Department of Education, Office of Management and Budget, and Office of the Controller 94 
General shall determine the allocations for this supplement for each local education agency 95 
prior to the disbursement of funds. 96 
(e) For any future salary supplements, increases, or adjustments for education positions that affect 97 
positions which are 100% funded by federal and/or local funds, it is the intent of the General 98 
Assembly that LEAs will be required to provide those supplements, increases, or adjustments 99 
through non- state funding resources. 100 
 Section 4.  Section 1 of this Act appropriates $3,000,000 to the Office of Management and Budget, One-101 
Times and Contingencies (10-02-11) to support DHIN and the Health Care Claims Database. These state funds 102 
will provide match to leverage federal resources.  103 
 Section 5. Section 1 of this Act appropriates $50,997,200 	to the Office of Management and Budget, 104 
Pensions (10-02-32) for Other Post-Employment Benefits. As directed by Executive Order 52, the Director of 105   Page 5 of 6

Office of Management and Budget shall transfer these funds to the Other Post-Employment Benefits Fund as 106 
established by 29 Del. C. § 5281.  107 
 Section 6. Section 1 of this Act appropriates $30,000,000 to the Delaware State Housing Authority (10	-08-108 
01) for Housing Investments.  Notwithstanding any law to the contrary, the Delaware State Housing Authority is 109 
authorized to utilize the funds allocated to address the housing crisis through state program	s designed to transform 110 
communities and neighborhoods through affordable housing initiatives, accelerate the creation of affordable 111 
housing communities, and preserve existing affordable housing inventory. DSHA shall administer these funds and 112 
is authorized to use no more than the greater of 7.5 percent or $2,250,000 of the appropriated amount for the 113 
support of DSHA administrative functions associated with this initiative. 114 
 Section 7. Section 1 of this Act provides an appropriation of $250,000 for Medicaid – Doula Services 115 
Contingency. These funds shall be used for technology system upgrades to the Department of Health and Social 116 
Services, Medicaid and Medical Assistance, Other Items: Medicaid (35-02-01), contingent upon the passage of 117 
House Bill 80 or similar legislation of the 152nd General Assembly. 118 
 Section 8. Section 1 of this Act appropriates $600,000 to the Department of Health and Social Services, 119 
Division of Services for Aging and Adults with Physical Disabilities (DSAAPD) 	(35-14-01) for home 120 
improvements and modifications allowing DSAAPD clients to safely age in place.  121 
 Section 9. Section 1 of this Act appropriates $5	00,000 to the Division of Climate, Coastal and Energy (40-122 
04-05) and $119,500 to the Department of Agriculture, Forest Service (65-01-04) for the Tree for Every 123 
Delawarean initiative. These funds shall only be used for planting trees that are approved by the Delaware Native 124 
Species Commission. 125 
 Section 10. Section 1 of this Act provides an appropriation of $36,778 for Equipment to the Department of 126 
Safety and Homeland Security, State Police, State Bureau of Identification (45-06-08). Of this amount, $8,778 of 127 
these funds shall be contingent upon the passage of Senate Substitute 1 for Senate Bill 46 or similar legislation of 128 
the 152nd General Assembly. 129 
 Section 11. Section 1 of this Act appropriates $200,000 to the State Election Commissioner (70-01-01) for 130 
Presidential Primary – Poll Worker Pay Increase. These funds shall be used to provide an increase in 131 
compensation for polling place staff as determined by the Elections Commissioner. 132 
 Section 12. Section 1 of this Act appropriates $1,040,000 to the Department of Education, District and 133 
Charter Operations, Other Items (95-02-02) to provide a one-year extension of the memorandum of understanding 134 
with Christina School District for the Wilmington School	s Initiative. 135   Page 6 of 6
