It is the policy of this State that meaningful sanctions be imposed upon those who allow dangerous conditions and defects to exist in leased premises and that an effective mechanism be established for repairing these conditions and halting their creation. This Act allows tenants to bring an action of rent escrow to pay rent into the court because of asserted defects or conditions. Alternatively, the tenant may refuse to pay rent and raise the existence of the asserted defects or conditions as an affirmative defense to an action for summary possession or an action for nonpayment of rent. This Act requires the tenant to give proper notice and allow the landlord the opportunity to effect repairs. This Act requires the court to make appropriate findings of fact and to make any order that justice of the case may require, which may include termination of the lease and return of the leased premises to the landlord, order that the action for rent escrow be dismissed, order that the amount of rent be reduced in amount determined by the court to be fair and equitable, or order the landlord to make the repairs or correct the conditions complained of by the tenant.

This Act changes how the Insurance Commissioner and the State Treasurer provide for distributions from taxes collected by the Insurance Commissioner to be made to fire companies or departments in Delaware. The current method for reporting, calculating, and making distributions to fire companies or departments is complex to administer and can lead to incorrect payments. This Act simplifies the reporting process and provides a new method for calculating the funds distributed to fire departments and companies in the City of Wilmington, New Castle County outside of Wilmington, Kent County, and Sussex County. Specifically, it reduces the number of payments per year from two to one, gives the Insurance Commissioner more time to ensure the accuracy of insurer-reported financial data, and establishes detailed guidelines for how the funds should be distributed to the various fire companies or departments. This Act also makes changes to the reporting requirements related to payments made by the State Treasurer to the State Insurance Coverage Office.

This Substitute bill clarifies that the definition of day does not include Saturday, Sunday, any federal holiday, or any State legal holiday when the specified number of days is 12 or less. When the specified number of days is more than 12 days, day means a calendar day. If the first or last day falls on a Saturday, Sunday, federal holiday, or State holiday under § 501 of Title 1, the date shall be extended to the next business day.

This Act implements a recommendation from the December 31, 2023, Report of the Retiree Healthcare Benefits Advisory Subcommittee. Under this Act, the state group health insurance program must include a pensioner coordination of benefits policy for eligible pensioners who were first employed by the State on or after January 1, 2015, and are eligible for health care coverage through their employer that is not through a plan under Chapter 52 of Title 29. The new pensioner coordination of benefits policy begins July 1, 2027, and must be comparable to the exiting coordination of benefits policy for the spouse of a state group health insurance program participant who is eligible for health care coverage through the spouse's own employer. This Act also codifies the existing spousal coordination of benefits policies for the state group health insurance program.

This Act implements a recommendation from the December 31, 2023, Report of the Retiree Healthcare Benefits Advisory Subcommittee (RHBAS). Under this Act, the State must continue to offer eligible pensioners first employed by the State as a regular officer or employee (first employed) before January 1, 2025, a plan that is comparable to the current Special Medicfill Medicare Supplement plan. However, for eligible pensioners first employed on or after January 1, 2025, the State may offer different Medicare supplement plans that are not high deductible plans.

This Act requires health spas selling subscription services online to provide a prospective buyer of such a subscription the right to cancel the automatic renewal online. This Bill would reinstate language formerly in the Delaware Code which would permit insurance agents to issue checks to policyholders in time sensitive situations without having to qualify as claims adjusters. This practice would be subject to regulation by the Department of Insurance.

This Act amends the Charter of the Town of Magnolia to update and clarify the authority of the Town to borrow money. Specifically, this Act increases the short-term borrowing limit from $15,000 to $50,000, which borrowings are to be authorized by a majority vote of the Town Council. This Act establishes procedures for the Town Council to borrow up to 15% of the assessed value of real property in the Town pursuant to a super-majority vote of the Town Council following a public hearing on the borrowing. The Towns long-term debt limit pursuant to the favorable vote of the qualified voters is being increased from 15% to 25% of the total assessed value of real property in the Town. This Act clarifies that the owner of more than one lot in an unfinished subdivision may only vote once in a borrowing referendum. This Act makes various miscellaneous changes to internal references to establish consistency with the changes made herein.

This Act makes technical changes for clarity by adding a definition of mental condition to the Code section that deals with relinquishment of firearms for persons who may be a danger to self or others (also known as a red flag law). It also extends the time periods for the Department of Justice to petition for a permanent order from 30 days to 60 days and allows the Superior Court to grant an extension of time to file for an additional 30 days. Under the existing law, the Superior Court may only grant a 15-day extension. The time within which a hearing is required to be held is extended from 15 days after the DOJs filing of a petition to 30 days. An ex parte emergency order issued by the JP Court will continue in effect during these time periods.

This Act requires the Delaware Real Estate Commission to create a comprehensive, statewide rights & responsibilities guide (guide) for landlords and tenants. This guide will reference responsibilities that a tenant or landlord must follow, including federal, state, county, and municipal requirements. This guide is to be created with input from other housing-related organizations, as needed. The Commission may amend the guide, including to update it and to add additional information that is relevant to landlords and tenants.

This Act requires that public school students receive a vision screening, including a test for color blindness, in kindergarten. Students must also receive vision screenings at appropriate intervals in grades 1 through 12, to be determined by the DOE.
