AN ACT TO AMEND TITLE 16 OF THE DELAWRE CODE RELATING TO PATIENT ABUSE.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE: Amend 1131, Title 16 of the Delaware Code by making insertions as shown by underline as follows: 1131. Definitions. For purposes of this subchapter: (4) Facility means all of the following: a. Any facility required to be licensed under this chapter. b. Any facility operated by or for the State which provides long-term care residential services. c. [Repealed.] d. Any hospital as defined under Chapter 10 of this title. Hospital is included in the definition of facility only for the purposes and application of this section and 1136 of this title. e. Any adult day care facility required to be licensed under Chapter 1 of this title.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

SYNOPSIS This Act provides that any adult day care facility required to be licensed under Chapter 1 of Title 16 is subject to the existing reporting obligations for facilities under Subchapter III of Chapter 11 of Title 16 of the Delaware Code. Author: Senator Mantzavinos
