SENATE BILL NO. 181
AN ACT TO AMEND TITLE 19 OF THE DELAWARE CODE RELATING TO THE DELAWARE CONTRACTOR REGISTRATION ACT.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE: Section 1. Amend 3609, Title 19 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows: 3609. Penalties. (a) A knowing violation of this chapter is subject to a civil penalty of not less than $5,000 and not more than $85,000 per violation. (b) A violation that is not a knowing violation may be subject to a civil penalty of not more than $1,000 per violation. (c) A contractor is jointly or severally liable for a violation of this chapter by a subcontractor. Joint or several liability means 2 or more contractors are jointly or severally liable for the same violation, whether or not the amount of the violation has been recovered against all or some of the contractors.
