 SENATE SUBSTITUTE NO. 1 

 FOR 

 SENATE BILL NO. 182 

   

 AN ACT TO AMEND TITLE 19 OF THE DELAWARE CODE RELATING TO THE DELAWARE CONTRACTOR REGISTRATION ACT. 

   

      BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:       Section 1. Amend 3607, Title 19 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:    3607. Denial, suspension, or revocation of certificate of registration.   (b)(1)  The Department shall reject an application that is incomplete or contains inaccurate information.  [Repealed.]   (2) a.  If a contractor knowingly supplies incomplete or inaccurate information to the Department under this  section, all of the following apply:  section, the Department may reject the application.   a. The application for registration must be rejected.   b.  The contractor may not apply for registration until 1 year from the date of the notice of disqualification.  If an application is rejected under paragraph (b)(2)a. of this section, the contractor may submit a new application for registration.   c.  The  If a contractor knowingly supplies incomplete or inaccurate information to the Department under this subsection, the  contractor is subject to other applicable penalties, including under Chapter 12 of Title 6.      

   

 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE: 

   

 Section 1. Amend 3607, Title 19 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows: 

  3607. Denial, suspension, or revocation of certificate of registration. 

 (b)(1)  The Department shall reject an application that is incomplete or contains inaccurate information.  [Repealed.] 

 (2) a.  If a contractor knowingly supplies incomplete or inaccurate information to the Department under this  section, all of the following apply:  section, the Department may reject the application.

      SYNOPSIS   This Act is a substitute for Senate Bill No. 182. Like Senate Bill No. 182, this act does all of the following:   (1) Grants the Department discretion to reject or accept an application that is incomplete or contains inaccurate information.   (2) Permits the contractor to submit a new application for registration if the Department rejected the application because it was incomplete or contains inaccurate information.      This Act differs from Senate Bill No. 182 in that it makes a technical correction to remove unnecessary language added to 3607(b)(2) of Title 19 by Senate Bill No. 182.  SYNOPSIS 

 This Act is a substitute for Senate Bill No. 182. Like Senate Bill No. 182, this act does all of the following:
