SENATE BILL NO. 75
AN ACT TO AMEND TITLE 17 OF THE DELAWARE CODE RELATING TO AUTHORITY IN INCORPORATED TOWNS AND CITIES; CONSTRUCTION AND MAINTENANCE OF HIGHWAYS.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE: Section 1. Amend 134, Title 17 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows: 134. Authority in incorporated towns and cities; construction and maintenance of highways; local authority. (g) Each rule and regulation adopted pursuant to this section shall be in the form of a resolution signed by the Secretary or the Secretarys designee . A permanent record of these shall be kept by the Department and at the time of adoption a copy of each shall be forwarded to the Department of Safety and Homeland Security, to the New Castle County Police, if within their jurisdiction, and to the incorporated city or town in which the highway lies.
