COVID-19 test kits; creating s. 627.42398, F.S.; 3 
defining the term "at -home COVID-19 test kit"; 4 
requiring health insurers and health maintenance 5 
organizations to provide 100 percent coverage for at -6 
home COVID-19 test kits; providing for expiration of 7 
the insurance coverage; providing an effective date. 8

Be It Enacted by the Legislature of the State of Flor ida: 10 
 11 
 Section 1.  Section 627.42398, Florida Statutes, is created 12 
to read: 13 
 627.42398  Coverage for at -home COVID-19 test kits.— 14 
 (1)  As used in this section, the term "at -home COVID-19 15 
test kit" means an over -the-counter diagnostic test kit that 16 
serves to detect active COVID -19 infections and for which the 17 
United States Food and Drug Administration has issued an 18 
Emergency Use Authorization. The term includes: 19 
 (a)  A COVID-19 self-collection kit, including, but not 20 
limited to, a polymerase chain reacti on (PCR) test, which 21 
provides results after a sample is received by a lab. 22 
 (b)  A COVID-19 self-test kit, including, but not limited 23 
to, a rapid antigen test, which provides results in minutes. 24 
 (2)  A health insurer or health maintenance organization 25

must provide 100 percent coverage for an at -home COVID-19 test 26 
kit that is purchased with or without a prescription, to be used 27 
at home or elsewhere. 28 
 (3)  This section expires December 31, 2023. 29 
 Section 2.  This act shall take effect upon becoming a law. 30
