ENROLLED HB 593 2022 Legislature CODING: Words stricken are deletions; words underlined are additions. hb0593-01-er Page 1 of 5 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S 1 An act relating to telecommunicator cardiopulmonary 2 resuscitation; amending s. 401.465, F.S.; providing 3 definitions; requiring certain 911 public safety 4 telecommunicators to complete biennial 5 telecommunicator cardiopulmonary resuscitation 6 training; authorizing certain agencies to enter into 7 reciprocal agreements with certain entities to provide 8 telephonic assistance in administering cardiopulmonary 9 resuscitation under certain circumstances; requiring 10 certain employees of such agencies to directly provide 11 telephonic assistance in administering cardiopulmonary 12 resuscitation, when appropriate, or transfer telephone 13 calls for emergency medical conditions to cer tain 14 entities; providing an effective date. 15 16 Be It Enacted by the Legislature of the State of Florida: 17 18 Section 1. Paragraph (c) of subsection (1) of section 19 401.465, Florida Statutes, is redesignated as paragraph (d), 20 subsections (3) and (4) are r enumbered as subsections (4) and 21 (5), respectively, paragraphs (b), (d), (i), and (j) of 22 subsection (2) of that section are amended, new paragraphs (c) 23 and (e) are added to subsection (1) of that section, and a new 24 subsection (3) is added to that section, to read: 25 ENROLLED HB 593 2022 Legislature CODING: Words stricken are deletions; words underlined are additions. hb0593-01-er Page 2 of 5 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S 401.465 911 public safety telecommunicator certification. — 26 (1) DEFINITIONS.—As used in this section, the term: 27 (c) "Public safety agency" has the same meaning as in s. 28 365.171(3)(d). 29 (e) "Telecommunicator cardiopulmonary resuscitation 30 training" means specific training, including continuous 31 education, that is evidence based and contains nationally 32 accepted guidelines for high -quality telecommunicator 33 cardiopulmonary resuscitation with the recognition of out -of-34 hospital cardiac arrest over th e telephone and the delivery of 35 telephonic instructions for treating cardiac arrest and 36 performing compression -only cardiopulmonary resuscitation. 37 (2) PERSONNEL; STANDARDS AND CERTIFICATION. — 38 (b) A public safety agency , as defined in s. 39 365.171(3)(d), may employ a 911 public safety telecommunicator 40 trainee for a period not to exceed 12 months if the trainee 41 works under the direct supervision of a certified 911 public 42 safety telecommunicator, as determined by rule of the 43 department, and is enrolled in a public safety telecommunication 44 training program. 45 (d) The department shall determine whether the applicant 46 meets the requirements specified in this section and in rules of 47 the department and shall issue a certificate to any person who 48 meets such requirements. Completion of an appropriate 911 public safety 51 telecommunication training program .; 52 2. Certification under oath that the applicant is not 53 addicted to alcohol or any controlled substance .; 54 3. Certification under oath that the applicant is free 55 from any physical or mental defect or disease that might impair 56 the applicant's ability to perform his or her duties .; 57 4. Submission of the application fee prescribed in 58 subsection (4). (3); 59 5. Submission of a completed application to the department 60 which indicates compliance with subparagraphs 1., 2., and 3. ; 61 and 62 6. Effective October 1, 2012, passage of an examination 63 approved by the department which measures the applicant's 64 competency and proficiency in the subject material of the public 65 safety telecommunication training program. 66 (i) If a person was employed as a 911 public safety 67 telecommunicator or a state -certified firefighter before April 68 1, 2012, he or she must pass the examination approved by the 69 department which measures the competency and proficiency in the 70 subject material of the public safety telecommunication program , 71 as defined in paragraph (1)(c) . Upon passage of the examination, 72 the completion of the public safety telecommun ication training 73 program is waived. 74 (j)1. Is selected by his or he r chief executive to perform as 79 a 911 public safety telecommunicator; 80 b. Performs as a 911 public safety telecommunicator on an 81 occasional or limited basis; and 82 c. Passes the department -approved examination that 83 measures the competency and proficiency of an applicant in the 84 subject material comprising the public safety telecommunication 85 program. 86 2. A sworn state-certified law enforcement officer who 87 fails an examination taken under subparagraph 1. must take a 88 department-approved public safety telecomm unication training 89 program before prior to retaking the examination. 90 3. The testing required under this paragraph is exempt 91 from the examination fee required under subsection (4) (3). 92 (3) TELECOMMUNICATOR CARDIOPULMONARY RESUSCITATION. — 93 (a) In addition to the certification and recertification 94 requirements in this section, 911 public safety 95 telecommunicators who answer telephone calls and provide 96 dispatch functions for emergency medical conditions must 97 complete telecommunicator cardiopulmonary resuscit ation training 98 every 2 years. 99 (b)1. A public safety agency or any agency that receives 100 ENROLLED HB 593 2022 Legislature CODING: Words stricken are deletions; words underlined are additions. hb0593-01-er Page 5 of 5 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S or dispatches telephone calls for emergency medical conditions 101 may enter into a reciprocal agreement with another public safety 102 agency or agency that receives or dispa tches such telephone 103 calls, a dedicated phone line, or a call center to provide 104 telephonic assistance in administering cardiopulmonary 105 resuscitation, if the applicable agency, dedicated phone line, 106 or call center that will be accepting the telephone calls 107 employs 911 public safety telecommunicators who have completed 108 telecommunicator cardiopulmonary resuscitation training pursuant 109 to paragraph (a). 110 2. Any employee of a public safety agency or agency 111 receiving or dispatching telephone calls for emergency m edical 112 conditions who answers such telephone calls must directly 113 provide telephonic assistance in administering cardiopulmonary 114 resuscitation, when appropriate, or transfer such calls to the 115 applicable agency, dedicated phone line, or call center with 116 which the transferring agency has a reciprocal agreement as 117 provided in subparagraph 1. 118 Section 2. This act shall take effect July 1, 2022. 119
