Paragraph (c) of subsection (3) of section 27 39.3065, Florida Statutes, is amended to read: 28 39.3065 Sheriffs of certain counties to provide child 29 protective investigative services; procedures; funding. — 30 (3) 31 (c) Funds for providing child protective investigat ions 32 must be identified in the annual appropriation made to the 33 department, which shall award grants for the full amount 34 identified to the respective sheriffs' offices. Notwithstanding 35 ss. 216.181(16)(b) and 216.351, the department may advance 36 payments to the sheriffs for child protective investigations. A 37 sheriff may carry forward documented unexpended state funds from 38 one fiscal year to the next. However, the cumulative amount of 39 state funds carried forward may not exceed 8 percent of the 40 sheriff's office total contract amount or grant agreement 41 amount. Any unexpended state funds in excess of that amount and 42 all unexpended federal funds must be returned to the department. 43 The funds carried forward may not be used to create increased 44 recurring future obliga tions or for any type of program or 45 service that is not currently authorized by the existing 46 contract or grant award agreement with the department. The 47 expenditure of funds carried forward must be separately reported 48 to the department. Funds for the child 51 protective investigations may not be integrated into the 52 sheriffs' regular budgets. Budgetary data and other data 53 relating to the performance of child protective investigations 54 must be maintained separately from all other records of the 55 sheriffs' offices and reported to the department as specified in 56 the grant award agreement. 57 Section 3. Subsection (3) of sec tion 129.06, Florida 58 Statutes, is amended to read: 59 129.06 Execution and amendment of budget. — 60 (3) Except as authorized in s. 30.49(12), only the 61 following transfers may be made between funds: 62 (a) Transfers to correct errors in handling receipts and 63 disbursements. 64 (b) Budgeted transfers. 65 (c) Transfers to properly account for unanticipated 66 revenue or increased receipts. 67 Section 4. This act shall take effect July 1, 2022. 68
