Be It Enacted by the Legislature of the State of Florida: 15

Section 1. Short title.—This act may be cited as "The 17
Villages Independent Fire Control and Rescue District Act," 18
hereinafter referred to as the "charter." 19
Section 2. Formation; boundaries. —For the purpose of 20
providing fire control; f ire prevention; and emergency medical, 21
rescue response, and public safety services pursuant to chapter 22
191, Florida Statutes, an independent special district is hereby 23
created, incorporated, and established pursuant to chapters 189 24
and 191, Florida Statute s, to be known as The Villages 25

Section 3. Intent.—The purposes of this act are to 423
provide: 424
(1) Standards, direction, and procedures concerning the 425

operation and governance of the district. 426
(2) A financing authority of the district without 427
hampering the efficiency and effectiveness of current authorized 428
and implemented methods and procedures of raising revenues. 429
(3) Improved communication and coordination betwe en the 430
district and other local governments with respect to short -range 431
and long-range planning to meet the demands for service delivery 432
while maintaining fiscal responsibility. 433
(4) Uniform procedures for electing members of the board 434
of commissioners of the district to ensure greater 435
accountability to the public. 436
Section 4. District board of commissioners; membership, 437
officers, and meetings. —The business affairs of the district 438
shall be conducted and administered, pursuant to chapter 191, 439
Florida Statutes, by the board of commissioners of The Villages 440
Independent Fire Control and Rescue District, which is 441
established as a board of five commissioners, elected, 442
organized, and operating pursuant to chapter 191, Florida 443
Statutes. 444
(1) Beginning on the ef fective date of this act, the 445
district shall be governed by a governing board consisting of 446
five members initially appointed by the Governor and thereafter 447
elected. After soliciting recommendations from the public, the 448
Governor may appoint members to the d istrict from the 449
candidates. 450

(2) For the inaugural appointment of members, two members 451
shall be appointed to serve an initial term of 2 years each and 452
3 members shall be appointed to serve an initial term of 4 years 453
each. Thereafter, each member shall be elected for a 4-year 454
term. 455
(3) The term of office for an appointed member shall begin 456
immediately after official appointment by the Governor and shall 457
expire upon the assumption of office by his or her successor. 458
Section 5. Powers and duties.—The district shall have, and 459
the board may exercise, all the powers and duties set forth in 460
chapters 189 and 191, Florida Statutes, and this act, as they 461
may be amended from time to time, which shall include fire 462
control, fire prevention, and emergency medical, rescue 463
response, and public safety services. Before exercising ad 464
valorem taxing authority, a majority of district electors voting 465
in a referendum conducted by the Supervisor of Elections of 466
Sumter County must approve the exercise of said authority. 467
Section 6. Boundaries.—The boundaries of the district may 468
be modified, extended, or enlarged upon approval or ratification 469
by the Legislature. 470
Section 7. Amendment of charter. —The charter may be 471
amended only by special act of the Legislature. 472
Section 8. Severability.—If any provision of this act or 473
its application to any person or circumstance is held to be 474
invalid, the invalidity shall not affect other provisions or 475

applications of this act which can be given effect without the 476
invalid provision or a pplication, and to this end the provisions 477
of this act are severable. 478
Section 9. Referendum election. —On or before December 31, 479
2023, the Supervisor of Elections of Sumter County shall conduct 480
a referendum of the qualified electors of the district on t he 481
question of whether the district shall be created by special act 482
of the Legislature pursuant to chapter 191, Florida Statutes. 483
The referendum question shall be in substantially the following 484

Section 10. This act shall take effect only upon its 505
