HB 1029 2022 CODING: Words stricken are deletions; words underlined are additions. hb1029-00 Page 1 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S A bill to be entitled 1 An act relating to senior citizen and teacher property 2 tax protection; prohibiting a tax collector from 3 including on forms, or assessing or collecting, 4 certain charges on property tax bills for certain 5 identified populations; prohibiting a tax collector 6 from authorizing a debt collection entity to collect 7 certain charges on property tax bills for certain 8 identified populations; prohibiting a tax collector 9 from selling a tax certificate on certain properties 10 under specified circumstances; requiring the 11 Department of Revenue to work with tax collectors to 12 identify mechanisms, strategies, and funding sources 13 for assisting certain populations pay for delinquent 14 charges; providing an effective date. 15 16 Be It Enacted by the Legislature of the State of Florida: 17 18 Section 1. (1) Notwithstanding any law to the contrary, a 19 tax collector may not include on any form sent out by the 20 office, or assess or collect, any fees, charges, taxes, or other 21 assessments, however labeled, for the delinquent payment of any 22 portion of the property tax bill, if a person is: 23 (a) Age 65 or older and is a low -income person or lives in 24 a low-income household as those terms are defined in s. 25 HB 1029 2022 CODING: Words stricken are deletions; words underlined are additions. hb1029-00 Page 2 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S 420.9071, Florida Statutes. 26 (b) A public school teacher whose annual salary is less 27 than $45,000. 28 (2) Notwithstanding any law to the contrary, a tax 29 collector may not authorize a debt collection entity to collect 30 outstanding fees, charges, taxes, or o ther assessments, however 31 labeled, for the delinquent payment of any portion of the 32 property tax bill, for a person who is age 65 or older and is a 33 low-income person or lives in a low -income household as those 34 terms are defined in s. 420.9071, Florida Stat utes. 35 (3) A tax collector or his or her designee may not sell a 36 tax certificate on property owned by a person who is age 65 or 37 older and is a low-income person or lives in a low -income 38 household as those terms are defined in s. 420.9071, Florida 39 Statutes, if the only portion of the tax bill that remains 40 unpaid are fees, charges, taxes, or other assessments, however 41 labeled, for the delinquent payment of any portion of the 42 property tax bill. 43 (4) The Department of Revenue shall work with the tax 44 collectors of the state to identify mechanisms, strategies, and 45 funding sources that may be utilized to assist persons 46 identified in paragraph (1)(a) with the payment of outstanding 47 fees, charges, taxes, or other assessments, however labeled, 48 related to the delinqu ent payment of any portion of a property 49 tax bill. 50 HB 1029 2022 CODING: Words stricken are deletions; words underlined are additions. hb1029-00 Page 3 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S Section 2.
