CS/HB 1139 2022 CODING: Words stricken are deletions; words underlined are additions. hb1139-01-c1 Page 1 of 4 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S A bill to be entitled 1 An act relating to energy; amending s. 286.29, F.S.; 2 revising the selection criteria for purchasing or 3 leasing vehicles for state agency, college, or 4 university or certain local government fleets; 5 requiring the Department of Management Services to 6 annually rank vehicles based on the lowest lifetime 7 ownership costs over a specified number of years and 8 to publish the rankings on the department's website; 9 providing that certain vehicles must be ranked at a 10 specified level unless an exception is approved by the 11 secretary of the department; exempting law enforcement 12 vehicles from the ranking requirement; removing a 13 provision requiring the use and procurement of ethanol 14 and biodiesel fuels; requiring the department, before 15 a specified date, to make recommendations to state 16 agencies and local governments relating to the 17 procurement and integration of electric and natural 18 gas fuel vehicles; amending s. 553.791, F.S.; revisi ng 19 the definition of the term "single -trade inspection"; 20 providing an effective date. 21 22 Be It Enacted by the Legislature of the State of Florida: 23 24 Section 1. Subsections (4) and (5) of section 286.29, 25 CS/HB 1139 2022 CODING: Words stricken are deletions; words underlined are additions. hb1139-01-c1 Page 2 of 4 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S Florida Statutes, are amended to read: 26 286.29 Climate-friendly public business. —The Legislature 27 recognizes the importance of leadership by state government in 28 the area of energy efficiency and in reducing the greenhouse gas 29 emissions of state government operations. The following shall 30 pertain to all state agencies when conducting public business: 31 (4) When procuring new vehicles, all state agencies, state 32 universities, community colleges, and local governments that 33 purchase vehicles under a state purchasing plan shall first 34 define the intended purpose for the vehicle and determine which 35 of the following use classes for which the vehicle is being 36 procured: 37 (a) State business travel, designated operator; 38 (b) State business travel, pool operators; 39 (c) Construction, agricultural, or maintenance work; 40 (d) Conveyance of passengers; 41 (e) Conveyance of building or maintenance materials and 42 supplies; 43 (f) Off-road vehicle, motorcycle, or all -terrain vehicle; 44 (g) Emergency response; or 45 (h) Other. 46 47 Vehicles described in paragraphs (a) through (h), when being 48 processed for purchase or leasing agreements, must be selected 49 based on the lowest lifetime ownership costs over 5 years as 50 CS/HB 1139 2022 CODING: Words stricken are deletions; words underlined are additions. hb1139-01-c1 Page 3 of 4 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S determined by the Department of Management Services. The 51 department shall annually rank vehicles based on the lowest cost 52 of ownership over 5 years using available industry data and 53 publish the rankings on the department's website. Any vehicle 54 that is a sedan or a light truck and is purchased under a state 55 purchasing plan must be ranked in the top 5 of the department's 56 rankings unless an exception is approved by the secretary of the 57 department and the secretary states the reason for the 58 exception. Law enforcement vehicles are exempt from the top 5 59 ranking requirement for the greatest fuel efficiency available 60 for a given use class when fuel economy data are available. 61 Exceptions may be made for individual vehicles in paragraph (g) 62 when accompanied, during the procurement process, by 63 documentation indicating that the operator or operators will 64 exclusively be emergency first responders or have special 65 documented need for exceptional vehicle performance 66 characteristics. Any request for an exception must be approved 67 by the purchasing agency head and any exceptional performance 68 characteristics denoted as a part of the procurement process 69 prior to purchase. 70 (5) All state agencies shall use ethanol and biodiesel 71 blended fuels when available. Before July 1, 2023, the Department of 76 Management Services shall make recommendations to state 77 agencies, including state colleges and universities, and local 78 governments regarding the procurement of electric and natural 79 gas fuel vehicles and best practices for integrating such 80 vehicles into existing fleets. 81 Section 3. Paragraph (p) of subsection (1) of section 82 553.791, Florida Statutes, is amended to read: 83 553.791 Alternative plans review and inspection. — 84 (1) As used in this section, the term: 85 (p) "Single-trade inspection" means any inspection focused 86 on a single construction trade, such as plumbing, mechanical, or 87 electrical. The term includes, but is not limited to, 88 inspections of door or window replacements; fences and block 89 walls more than 6 feet high from the top of the wall to the 90 bottom of the footing; stucco or plastering; reroofing with no 91 structural alteration; HVAC replacements; installation of 92 electric vehicle charging stations; solar energy and energy 93 storage installations or alterations; ductwork or fan 94 replacements; alteration or installation of wiring, lighting, 95 and service panels; water heater changeouts; sink replacements; 96 and repiping. 97 Section 4. This act shall take effect July 1, 2022. 98
