A bill to be entitled 1 
An act relating to fees; amending s. 581.217, F.S.; 2 
requiring an applicant seeking a hemp extract or hemp 3 
extract product registration certificate to submit an 4 
application fee to the Department of Agriculture and 5 
Consumer Services; requiring that such application fee 6 
be deposited into a specified trust fund; providing a 7 
contingent effective date. 8

Be It Enacted by the Legislature of the State of Florida: 10 
 11 
 Section 1.  Paragraph (b) of subsection (7) of section 12 
581.217, Florida Statutes, as created by HB 679, is amended to 13 
read: 14 
 581.217  State hemp program. — 15 
 (7)  DISTRIBUTION OF HEMP EXTRACT AND HEMP EXTRACT 16 
PRODUCTS.— 17 
 (b)  Each hemp extract and hemp extra ct product 18 
manufactured or distributed in the state must be registered with 19 
the department before distribution. The person or entity whose 20 
name appears on the label of the hemp extract or hemp extract 21 
product must apply to the department for a registration 22 
certificate on a form prescribed by the department. By applying 23 
to register the hemp extract or hemp extract product, the 24 
applicant assumes full responsibility for the registration, 25

quality, and quantity of the extract or product manufactured or 26 
distributed in the state. A hemp extract or hemp extract product 27 
registration certificate is valid for 1 year after the date of 28 
issuance and must be renewed annually on or before its 29 
expiration date. 30 
 1.  A completed registration certificate application must 31 
be accompanied by all of the following: 32 
 a.  A sample of the hemp extract or hemp extract product 33 
and a copy of the proposed labeling as it will be manufactured 34 
or distributed. 35 
 b.  A certificate of analysis pursuant to paragraph (a) 36 
which is dated no more than 30 days before the date upon which 37 
the registration application is submitted. 38 
 c.  An application fee not to exceed $500 for each hemp 39 
extract or hemp extract product established by department rule. 40 
The application fee shall be deposited into the departmen t's 41 
General Inspection Trust Fund. 42 
 2.  The department may analyze a sample of the hemp extract 43 
or hemp extract product and inspect the label to ensure that the 44 
extract or product: 45 
 a.  Meets all proposed labeling claims. 46 
 b.  Meets all requirements under this subsection and 47 
department rules. 48 
 c.  Contains an acceptable hemp THC level. 49 
 d.  Is not adulterated or misbranded pursuant to chapter 50

500, chapter 502, or chapter 580. 51 
 3.  The department shall deny a registration certificate 52 
application that does not meet the requirements of this 53 
paragraph or department rules. 54 
 Section 2.  This act shall take effect on the same date 55 
that HB 679 or similar legislation takes effect , if such 56 
legislation is adopted in the same legislative session or an 57 
extension thereof and becomes a law. 58
