F.S.; providing conditions for local governments 4
seeking liquidated damages, administrative fees, or 5
other charges against public or private solid waste 6
management or recycling entities; providing 7
applicability; providing an effective date. 8

Be It Enacted by the Legislature of the State of Florida: 10

Section 1. Subsection (23) of section 403.706, Florida 12
Statutes, is renumbered as subsection (24) and a new subsection 13
(23) is added to that section to read: 14
403.706 Local government solid waste responsibilities. — 15
(24) The following conditions apply to all contracts 16
between a county or municipality for the collection or transport 17
of solid waste or recyclable material executed or renewed on or 18
after July 1, 2022: 19
(a) The governing body of any local government may not 20
seek liquidated damages, administrative fees, or other similar 21
charges against a public or private solid waste management or 22
recycling entity for action or inaction when a local, state, or 23
federal emergency is in effect. 24
(b) Any liquidated damages, administrative fees, or other 25

similar charges must be calculated on, and may not exceed 50 26
percent of, the amount billed to the customer for solid waste or 27
recycling collection services billed for that day at the daily 28
rate. 29
Section 2. This act shall take effect July 1, 2022. 30
