Section 633.3041, Florida Statutes, is created 11 to read: 12 633.3041 Firefighting foam. — 13 (1) As used in this section, the term: 14 (a) "Class B firefighting foam" means any foam designed to 15 extinguish flammable liquid fires. 16 (b) "PFAS chemicals" means a class of fluorinated organic 17 chemicals containing at least one fully fluorinated carbon atom, 18 including perfluoroalkyl and polyfluoroalkyl substances, 19 designed to be fully functional in Class B firefighting foam 20 formulations. 21 (c) "Testing" means calibration, conformance, or fixed 22 system testing. 23 (2) Beginning January 1, 2023, a fire service provider may 24 not discharge or otherwise use Class B firefighting foam that 25 HB 1257 2022 CODING: Words stricken are deletions; words underlined are additions. hb1257-00 Page 2 of 2 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S contains intentionally added PFAS chemicals unless such 26 discharge or use occurs in fire prevention or in response to an 27 emergency firefighting operation. 28 (3) This section does not: 29 (a) Restrict the manufacturing, sale, or distribution of 30 Class B firefighting foam that contains intentionally added PFAS 31 chemicals or restrict the discharge or use of Class B 32 firefighting foam in response to fire prevention or an emergency 33 firefighting operation. 34 (b) Prevent the use of nonfluorinated foams, including 35 other Class B firefighting foams, for purposes of firefighter 36 training or testing. 37 Section 2. This act shall take effect July 1, 2022. 38
