A bill to be entitled 1 
An act relating to municipal contraction procedures; 2 
amending s. 171.051, F.S.; specifying the method of 3 
contracting a municipality when a specified percentage 4 
of landowners are not registered electors of the area; 5 
specifying the method of contracting a municipality 6 
when there are no registered electors in the area 7 
proposed to be contracted; providing an effective 8 
date. 9

Be It Enacted by the Legislature of th e State of Florida: 11 
 12 
 Section 1.  Subsections (11) and (12) are added to section 13 
171.051, Florida Statutes, to read: 14 
 171.051  Contraction procedures. —Any municipality may 15 
initiate the contraction of municipal boundaries in the 16 
following manner: 17 
 (11)  Notwithstanding subsections (2) and (4), if more than 18 
70 percent of the land in an area proposed for contraction is 19 
owned by individuals, corporations, or legal entities that are 20 
not registered electors of that area, the area may only be 21 
contracted if the owners of more than 50 percent of the total 22 
area of the land in the area consent to the contraction. Such 23 
consent shall be obtained by the parties proposing the 24 
contraction before the referendum to be held on the contraction, 25

as set forth in subsections (6) and (7), is held. 26 
 (12)  Notwithstanding subsections (2) and (4), if the area 27 
proposed for contraction does not have any registered electors 28 
on the date the ordinance is adopted, a vote of electors of the 29 
area is not required. In addition to meeting the r equirements of 30 
subsection (11), the area may only be contracted if the owners 31 
of more than 50 percent of the parcels of land in the area 32 
proposed for contraction consent to the contraction. If the 33 
governing body does not hold a referendum of the contractin g 34 
municipality under subsection (2), the consent of the property 35 
owners that are required under subsection (11) shall be obtained 36 
by the parties proposing the contraction before the final 37 
adoption of the ordinance, and the ordinance shall become 38 
effective upon its adoption or as otherwise provided in the 39 
ordinance. 40 
 Section 2.  This act shall take effect July 1, 2022. 41
