An act relating to Alligator Point Water Resources 2
District, Franklin County; amending ch. 2005-351, Laws 3
of Florida; revising district boundaries; requiring 4
the annual collection of ad valorem taxes beginning on 5
a specified date; revising the referendum date; 6
providing effective dates. 7

Be It Enacted by the Legislature of the State of Flor ida: 9

Section 1. Sections 3 and 8 of section 3, and section 6, 11
and section 3 of section 7 of chapter 2005 -351, Laws of Florida, 12
are amended to read: 13
Section 3. There is created in Franklin County an 14
independent special district to be known as Allig ator Point 15
Water Resources District. The district shall include all that 16
portion of Alligator Point in said county described as follows: 17

Fractional sections 4, 5, 6 and 7 in Township 7, 19
South, Range 1 West and fractional section 1, 2, 3 and 20
12 in Township 7 South, Range 2 West. All of sections 21
28, 31, 32 and 33, Township 6 south, Range 1 West, 22
Franklin County, Florida. 23

Section 8. Beginning January 1, 2022, and annually 25
thereafter unless otherwise provided by law, all taxable 26
property within the distri ct shall be subject to an ad valorem 27
tax not to exceed 5 mills of the assessed valuation of such 28
property to be used to carry out the purposes of this act. In 29
accordance with timetables set by Florida Statutes, each year 30
the district board shall meet and d etermine the millage 31
necessary to provide funds to be levied and assessed on such 32
property to carry out the purposes of this act; provided, 33
however, that the millage determined by the board shall not 34
exceed the limitations of this section. The ad valorem t ax 35
authorized by this section shall be levied and collected in the 36
same manner as taxes for county purposes are assessed and 37
collected in Franklin County. Taxes of the district shall be of 38
equal dignity with taxes for county purposes and shall become 39
liens and be enforced in the same manner as taxes for county 40
purposes. 41
Section 6. In accordance with provisions of law relating 42
to elections currently in force, the Alligator Point Water 43
Resources District shall call and the Franklin County Supervisor 44
of Elections shall conduct a referendum no later than November 45
30, 2022 2006, of the qualified electors residing within the 46
area proposed to be annexed pursuant to section 7. "Qualified 47
elector" means a person who is a registered voter qualified to 48

vote in a general election held in Franklin County. The purpose 49
of said referendum shall be to determine whether the boundaries 50
of the Alligator Point Water Resources District shall be 51
expanded to include land that is not currently within the 52
district's boundaries as described in section 7, and whether 53
property within the annexed area shall be subject to ad valorem 54
taxation at a rate not to exceed 5 mills. 55
Section 7. Effective 15 days after approval by a majority 56
vote of those qualified electors residing within the area 57
proposed to be annexed and voting on the question in the 58
referendum, section 3 of the charter contained in section 3 of 59
this act shall be amended to read: 60
Section 3. There is created in Franklin County a special 61
taxing district to be known as All igator Point Water Resources 62
District. The district shall include all that portion of 63
Alligator Point in said county described as follows: 64
