Subsection (8) is added to section 595.420, 16 Florida Statutes, to read : 17 595.420 Food recovery; legislative intent; department 18 functions.— 19 (8)(a) As used in this subsection: 20 1. "Agricultural company" means a fruit or vegetable 21 producer in the state that has an affiliated shipper and is 22 licensed under the United States P erishable Agricultural 23 Commodities Act. 24 2. "Food recovery entity" means a nonprofit association 25 HB 1567 2022 CODING: Words stricken are deletions; words underlined are additions. hb1567-00 Page 2 of 2 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S engaged in food recovery and distribution with at least 20 years 26 of operation in the state. 27 (b) Subject to appropriation, the department shall 28 implement a pilot program to provide funds to food recovery 29 entities to expand capabilities for extending the shelf life of 30 fresh produce, including, but not limited to, labor, purchasing, 31 packaging, storage, transportation, and distribution. 32 (c) To qualify for fundi ng under this section, the food 33 recovery entity must apply to the department and provide 34 documentation that it receives fresh fruits and vegetables from 35 an agricultural company, has food processing equipment and 36 production capabilities, and operates a job training program. 37 (d) The department shall submit a report on the pilot 38 program, including recommendations for legislation, to the 39 Governor, the President of the Senate, and the Speaker of the 40 House of Representatives by January 1, 2025. 41 (e) The department shall adopt rules to implement this 42 subsection. 43 Section 2. For the 2022-2023 fiscal year, the sum of $2 44 million in nonrecurring funds is appropriated from the General 45 Revenue Fund to the Department of Agriculture and Consumer 46 Services to implement a pilot program pursuant to s. 595.420(8), 47 Florida Statutes. 48 Section 3. This act shall take effect July 1, 2022. 49
