A bill to be entitled 1 
An act relating to the preemption of recyclable and 2 
polystyrene materials; amending s. 403.7033, F.S.; 3 
removing the prohibition of local regulation of 4 
auxiliary containers, wrappings, and disposable 5 
plastic bags; repealing s. 500.90, F.S., relating to 6 
the preemption of the use or sale of polystyrene 7 
products to the Department of Agriculture and Consumer 8 
Services; providing an effective date. 9

Be It Enacted by the Legislature of the State of Florida: 11 
 12 
 Section 1.  Section 403.7033, Florida Statutes, is amended 13 
to read: 14 
 403.7033  Departmental analysis of particular recyclable 15 
materials.—The Legislature finds that prudent regulation of 16 
recyclable materials is c rucial to the ongoing welfare of 17 
Florida's ecology and economy. As such, the Department of 18 
Environmental Protection shall review and update its 2010 report 19 
on retail bags analyzing the need for new or different 20 
regulation of auxiliary containers, wrappings , or disposable 21 
plastic bags used by consumers to carry products from retail 22 
establishments. The updated report must include input from state 23 
and local government agencies, stakeholders, private businesses, 24 
and citizens and must evaluate the efficacy and n ecessity of 25

both statewide and local regulation of these materials. To 26 
ensure consistent and effective implementation, the department 27 
shall submit the updated report with conclusions and 28 
recommendations to the Legislature no later than December 31, 29 
2021. Until such time that the Legislature adopts the 30 
recommendations of the department, a local government, local 31 
governmental agency, or state governmental agency may not enact 32 
any rule, regulation, or ordinance regarding use, disposition, 33 
sale, prohibition, re striction, or tax of such auxiliary 34 
containers, wrappings, or disposable plastic bags. 35 
 Section 2.  Section 500.90, Florida Statutes, is repealed. 36 
 Section 3.  This act shall take effect July 1, 2022. 37
