A bill to be entitled 1 
An act relating to the Emergency Preparedness and 2 
Response Fund; amending s. 11.90, F.S.; authorizing 3 
the Legislative Budget Commission to convene to 4 
transfer or appropriate certain funds to the Emergency 5 
Preparedness and Response Fund; amending s. 252.37, 6 
F.S.; revising legislative intent; authorizing the 7 
Governor to transfer and expend moneys from the 8 
Emergency Preparedness and Response Fund; authoriz ing 9 
the Governor to request that additional funds be 10 
transferred or appropriated to the Emergency 11 
Preparedness and Response Fund, subject to approval by 12 
the Legislative Budget Commission, under specified 13 
conditions; providing a transfer of funds; providing a 14 
contingent effective date. 15

Be It Enacted by the Legislature of the State of Florida: 17 
 18 
 Section 1.  Subsection (8) is added to section 11.90, 19 
Florida Statutes, to read: 20 
 11.90  Legislative Budget Commission. — 21 
 (8)  The commission may convene to tr ansfer or appropriate 22 
unappropriated surplus funds to the Emergency Preparedness and 23 
Response Fund created under s. 252.3711. 24 
 Section 2.  Subsection (2) of section 252.37, Florida 25

Statutes, is amended to read: 26 
 252.37  Financing.— 27 
 (2)(a) It is the legislative intent that the first 28 
recourse be made to funds specifically regularly appropriated to 29 
state and local agencies for disaster relief or response . 30 
 (b) If the Governor finds that the demands placed upon 31 
these funds in coping with a particular disas ter declared by the 32 
Governor as a state of emergency are unreasonably great, she or 33 
he may make funds available by transferring and expending moneys 34 
appropriated for other purposes, by transferring and expending 35 
moneys out of any unappropriated surplus fun ds, or from the 36 
Emergency Preparedness and Response Budget Stabilization Fund 37 
created under s. 252.3711. The Governor may request that 38 
additional funds be transferred or appropriated to the Emergency 39 
Preparedness and Response Fund by a budget amendment, su bject to 40 
approval of the Legislative Budget Commission . 41 
 (c) Following the expiration or termination of the state 42 
of emergency, the Governor may transfer moneys with a budget 43 
amendment, subject to approval by the Legislative Budget 44 
Commission, to satisfy the budget authority granted for such 45 
emergency. The transfers and expenditures supporting the 46 
amendment must be directly related to the declared disaster or 47 
emergency. 48 
 Section 3.  The Chief Financial Officer shall immediately 49 
transfer the nonrecurring sum of $500 million from the General 50

Revenue Fund to the Emergency Preparedness and Response Fund in 51 
the Executive Office of the Governor to be used for preparing 52 
for or responding to a disaster declared by the Governor as a 53 
state of emergency. 54 
 Section 4.  This act shall take effect on the same date 55 
that HB 7023 or similar legislation takes effect , if such 56 
legislation is adopted in the same legislative session or an 57 
extension thereof and becomes a law. 58
