A reviser's bill to be entitled 1 
An act relating to the Florida Statutes; amending ss. 2 
267.1736, 341.822, 341.840, 475.631, 482.0815, 3 
497.150, and 497.160, F.S., to conform to the 4 
directive of the Legislature in section 9 of chapter 5 
2012-116, Laws of Florida, codified as section 6 
11.242(5)(j), Florida Statutes, to prepare a reviser's 7 
bill to omit all statutes and laws, or parts thereof, 8 
which grant duplicative, redundant, or unused 9 
rulemaking authority; providing an effective date. 10 
 11 
Be It Enacted by the Legislature of the State of Florida: 12 
 13 
 Section 1.  Subsection (5) of section 267.1736, Florida 14 
Statutes, is amended to read: 15 
 267.1736  Direct-support organization. — 16 
 (5)  The university shall establish policies and may adopt 17 
rules pursuant to s. 1004.28 prescribing the procedures by which 18 
the direct-support organization is governed and any conditions 19 
with which a direct-support organization must comply to use 20 
property, facilities , or personal services of the university. 21 
 Section 2.  Paragraph (c) of subsection (2) of section 22 
341.822, Florida Statutes, is amended to read: 23 
 341.822  Powers and duties. — 24

 (c)  The enterprise shall establish a process to issue 26 
permits to railroad companies for the construction of 27 
communication facilities within a new or existing public or 28 
private high-speed rail system. The enterprise may adopt rules 29 
to administer such permits, including rules regarding the form, 30 
content, and necessary supporting documentation for permit 31 
applications; the process for submitting applications; and the 32 
application fee for a permit under s. 341.825. The enterprise 33 
shall provide a copy of a completed permit application to 34 
municipalities and counties where the high -speed rail system 35 
will be located. The enterprise shall allow each such 36 
municipality and county 30 days to provide comments to the 37 
enterprise regarding the application, including any 38 
recommendations regarding conditions that may be placed on the 39 
permit. 40 
 Section 3.  Paragraphs (f) and (g) of subsection (7) of 41 
section 341.840, Florida Statutes, are amended to read: 42 
 341.840  Tax exemption. — 43

 (f)  The enterprise may adopt rules governing the 45 
application process for exemption of a contractor as an 46 
authorized agent of the enterprise. 47 
 (g)  The Department of Revenue may adopt rules governing 48 
the issuance and form of high -speed rail system exemption 49 
permits, the audit of contractors and subcontractors using such 50

permits, the recapture of taxes on nonqualified p urchases, and 51 
the manner and form of refund applications. 52 
 Section 4.  Subsection (2) of section 475.631, Florida 53 
Statutes, is amended to read: 54 
 475.631  Nonresident licenses and certifications. — 55 
 (2)  All nonresident applicants, certified appraisers, and 56 
licensees shall comply with all requirements of board rules and 57 
this part. The board may adopt rules pursuant to ss. 120.536(1) 58 
and 120.54 necessary for the regulation of nonresident certified 59 
appraisers and licensees. 60 
 Section 5.  Subsection (11) of section 482.0815, Florida 61 
Statutes, is amended to read: 62 
 482.0815  Permit to perform preventive termite treatment 63 
services for new construction only. — 64 
 (11)  The department shall adopt rules necessary to 65 
administer this section. 66 
 Section 6.  Subsection (12) of section 497.150, Florida 67 
Statutes, is amended to read: 68 
 497.150  Compliance examinations of existing licensees. — 69 
 (12)  The department may adopt rules pursuant to ss. 70 
120.536(1) and 120.54 for the implementation of this section. 71 
 Section 7.  Subsection (3) of section 497.160, Florida 72 
Statutes, is amended to read: 73 
 497.160  Receivership proceedings. — 74

Reviser's note.—This act amends provisions of the Florida 77 
Statutes pursuant to the directive of the Legislature in s. 78 
9, ch. 2012-116, Laws of Florida, codified as s. 79 
11.242(5)(j), Florida Statutes, to prepare a reviser's bill 80 
to omit all statutes and laws, or parts thereof , which 81 
grant duplicative, redundant, or unused rulemaking 82 
authority. 83 
 Section 8.  This act shall take effect on the 60th day 84 
after adjournment sine die of the session of the Legislature in 85 
which enacted. 86
