II.Summary of Amendments Contained in Message: 
House Amendment – 477889 removes language in the Senate bill that is relevant to workers’ 
compensation. This language is not relevant to the bill, which requires a law enforcement agency 
to provide motor vehicle insurance coverage for a law enforcement vehicle the agency authorizes 
a law enforcement officer to take home. The amendment is also a conforming amendment 
because the House bill does not contain this language. 
 
Specifically, the Senate bill provides that if an employing agency authorizes a law enforcement 
officer to travel to his or her place of residence in an official law enforcement vehicle “outside of 
the course and scope of the officer’s employment or function,” the employing agency must 
maintain current and valid motor vehicle insurance coverage as specified in the bill. The quoted 
language is removed by the House amendment. The removed language is relevant to the “going 
or coming” rule in workers compensation. Section 440.092(2), F.S., provides that, except as 
otherwise provided in that subsection, an injury to a law enforcement officer during the officer’s 
work period or while going to or coming from work in an official law enforcement vehicle is 
presumed to be an injury arising out of and in the course of employment unless the injury 
occurred during a distinct deviation for a nonessential personal errand. The bill does not address 
workers’ compensation; therefore, the removed language has no bearing on the bill’s purpose.
