II.Summary of Amendments Contained in Message:
House Amendment – 568773 is a delete all amendment, and creates s. 794.051, F.S., Indecent,
lewd or lascivious touching of certain minors.
The amendment provides that it is a third degree felony for a person 24 years of age or older to
touch in a lewd or lascivious manner the breasts, genitals, genital area, or buttocks, or the
clothing covering them, of a person 16 or 17 years of age, or forces or entices a person 16 or 17
years of age to so touch the perpetrator.
The new crime does not apply to a person 16 or 17 years old who has had the disability of
nonage removed under ch. 743, F.S.
This crime is ranked as a level 4 offense in the Offense Severity Ranking Chart of the Criminal
Punishment Code.
