II.Summary of Amendments Contained in Message: 
House Amendment – 028079 is a delete all amendment.  
 
The amendment removes language amending s. 90.404, F.S., which provided substantial 
similarity is not required for admission of the defendant’s commission of other crimes, wrongs, 
or acts involving a sexual offense, when the defendant is charged with a sexual offense and his or 
her identity is not at issue.  
 
The amendment removes language amending s. 775.15, F.S., which expanded the statute of 
limitations by one year for certain victims of sexual battery.  
 
Additionally, it removes the language added to s. 794.011(3), F.S., which provided it was a life 
felony to use or threaten to use actual physical force likely to cause serious personal injury or 
death, during the commission of a sexual battery on a person 12 years of age or older.  
 
The amendment defines the term “female genitals,” in ss. 365.161, 491.0112, 775.0847, 794.05, 
796.07, 800.04, 825.1025, 827.071, 847.001, 872.06, 944.35, and 951.27, F.S.
