Florida Senate - 2022 CS for SB 1664 By the Committee on Judiciary; and Senators Perry and Boyd 590-02522-22 20221664c1 1 A bill to be entitled 2 An act relating to unlawful assemblies; amending s. 3 870.02, F.S.; prohibiting a person or persons from 4 picketing or protesting before or about the residence 5 or dwelling of any person with specified intent; 6 defining the term dwelling; providing criminal 7 penalties; providing an effective date. 8 9 Be It Enacted by the Legislature of the State of Florida: 10 11 Section 1.Section 870.02, Florida Statutes, is amended to 12 read: 13 870.02Unlawful assemblies. 14 (1)(a)If three or more persons meet together to commit a 15 breach of the peace, or to do any other unlawful act, each of 16 them commits a misdemeanor of the second degree, punishable as 17 provided in s. 775.082 or s. 775.083. 18 (b)(2)A person arrested for a violation of paragraph (a) 19 this section shall be held in custody until brought before the 20 court for admittance to bail in accordance with chapter 903. 21 (2)(a)In an effort to serve the states significant 22 interest in protecting the well-being, tranquility, and privacy 23 of the home and protecting residents from the detrimental effect 24 of targeted picketing, it is unlawful for a person or persons to 25 picket or protest before or about the residence or dwelling of 26 any person with the intent to harass or disturb that person in 27 his or her home. As used in this paragraph, the term dwelling 28 means any building, structure, or portion thereof which is 29 occupied as, or designed or intended for occupancy as, a 30 residence by one or more families. 31 (b)A person who violates paragraph (a) commits a 32 misdemeanor of the second degree, punishable as provided in s. 33 775.082 or s. 775.083. 34 Section 2.This act shall take effect October 1, 2022.
