Subsection (4) is added to section 509.101, 12 Florida Statutes, to read: 13 509.101 Establishment rules; posting of notice; food 14 service inspection report; maintenance of guest register; mobile 15 food dispensing vehicle registry. — 16 (4)(a) For purposes of this subsection, "temporary 17 commercial kitchen" means a food preparation and cooking 18 facility set up for the preparation of takeout or delivery -only 19 meals housed in portable structures that are movable from place 20 to place by a tow or are self -propelled or otherwise axel 21 mounted. The term does not include a tent or shed. 22 (b) The division shall establish rules for the operation 23 of temporary commercial kitchens. Be climate-controlled. 26 2. Maintain a humidity factor of less than 60 percent in 27 the space of the unit. 28 3. Have a total gross weight not exceeding 5,000 pounds. 29 4. Maintain ADA compliant entrances and access windows. 30 5. Maintain a sink in compliance with Department of 31 Business and Professional Regulation standards. 32 6. Maintain either internal or external fresh water supply 33 and gray water disposal. 34 7. Maintain electrical, plumbing, and mechanical 35 specifications that meet or exceed national agency standards or 36 best industry standa rds. 37 8. Maintain a wind rating greater than 70 mph. 38 Section 2. This act shall take effect July 1, 2023. 39
