A bill to be entitled 1 
An act relating to driving in the furthermost left -2 
hand lane of a roadway; amending s. 316.081, F.S.; 3 
prohibiting a driver from continuously operating a 4 
motor vehicle in the furthermost left -hand lane of 5 
certain roadways, except under certain circumstances; 6 
providing applicability; providing a penalty; 7 
providing an effective date. 8

Be It Enacted by the Legislature of the State of Florida: 10 
 11 
 Section 1.  Subsections (4) and (5) of section 316.081, 12 
Florida Statutes, are renumbered as subsections (5) and (6), 13 
respectively, a new subsection (4) is added to that section, and 14 
present subsection (5) of that section is republished, to read: 15 
 316.081  Driving on right side of roadway; exceptions. — 16 
 (4)  On a road, street, or highway having two or more lanes 17 
allowing movement in the same direction with a posted speed 18 
limit of at least 65 miles per hour, a driver may not 19 
continuously operate a motor vehicle in the furthermost left-20 
hand lane, except when overtaking and passing another vehicle, 21 
when preparing to exit the road, street, or highway, or when 22 
otherwise directed by an official traffic control device. This 23 
subsection does not apply to authorized emergency v ehicles and 24 
vehicles engaged in highway maintenance or construction 25

operations. 26 
 (6)(5) A violation of this section is a noncriminal 27 
traffic infraction, punishable as a moving violation as provided 28 
in chapter 318. 29 
 Section 2.  This act shall take effect January 1, 2024. 30
