A bill to be entitled 1
An act relating to driving in the furthermost left -2
hand lane of a roadway; amending s. 316.081, F.S.; 3
prohibiting a driver from operating a motor vehicle in 4
the furthermost left -hand lane of certain roadways, 5
except under certain circumstances; defining the term 6
"furthermost left-hand lane"; providing applicability; 7
providing a penalty; providing an effective date. 8

Be It Enacted by the Legislature of the State of Florida: 10

Section 1. Subsections (4) and (5) of section 316.081, 12
Florida Statutes, are renumbered as subsections (5) and (6), 13
respectively, a new subsection (4) is added to that section, and 14
present subsection (5) of that section is republishe d, to read: 15
316.081 Driving on right side of roadway; exceptions. — 16
(4) On a road, street, or highway having two or more lanes 17
allowing movement in the same direction with a posted speed 18
limit of at least 65 miles per hour, a driver may not operate a 19
motor vehicle in the furthermost left -hand lane, except when 20
overtaking and passing another vehicle, when preparing to exit 21
the road, street, or highway, or when otherwise directed by an 22
official traffic control device. As used in this subsection, the 23
term "furthermost left-hand lane" means the farthest most left -24
hand lane, except that, if such left -hand lane is a high-25

occupancy-vehicle lane as defined in s. 316.0741 or is a 26
designated left-hand turn lane, the furthermost left -hand lane 27
is the lane immediately to the right of such high -occupancy-28
vehicle lane or left -hand turn lane. This subsection does not 29
apply to authorized emergency vehicles and vehicles engaged in 30
highway maintenance or construction operations. 31
(6)(5) A violation of this section is a non criminal 32
traffic infraction, punishable as a moving violation as provided 33
in chapter 318. 34
Section 2. This act shall take effect January 1, 2024. 35
