amending s. 20.155, F.S.; authorizing the Office of 4
Inspector General to issue and serve subpoenas duces 5
tecum for specified purposes and require or allow 6
certain persons to file specified statements; 7
authorizing the office to petition certain courts for 8
specified purposes; providing an effective date. 9

Be It Enacted by the Legislature of the State of Florida: 11

Section 1. Subsection (5) of section 20.155, Florida 13
Statutes, is amended to read: 14
20.155 Board of Governors of the State University System. — 15
(5)(a) OFFICE OF INSPECTOR GENERAL. —An Office of Inspector 16
General shall be organized using existing resources and funds to 17
promote accountability, efficiency, and effectiveness and to 18
detect fraud and abuse within state universities. If the Board 19
of Governors determines that a state university board of 20
trustees is unwilling or unable to address substantiated 21
allegations made by any person relating to waste, fraud, or 22
financial mismanagement, the office shall conduct, coordinate, 23
or request investigations into substantiated allegations made by 24
any person relating to waste, fraud, or financial mismanagement 25

within a state university. The office shall have access to all 26
information and personnel necessary to perform its duties and 27
shall have all of its current powers, duties, and 28
responsibilities authoriz ed in s. 20.055. 29
(b)1. In exercising authority under this subsection, the 30
Office of Inspector General or his or her designee may: 31
a. Issue and serve subpoenas duces tecum for the Board of 32
Governors or the state universities in the State University 33
System to compel the attendance of witnesses and the production 34
of documents, reports, answers, records, accounts, and other 35
data in any medium. 36
b. Require or allow a person to file a statement in 37
writing, under oath or otherwise, as to all the facts and 38
circumstances concerning the matter to be audited, examined, or 39
investigated. 40
2. In the event of noncompliance with a subpoena issued 41
under this paragraph, the Inspector General may petition the 42
circuit court of the county in which the person subpoenaed 43
resides or has his or her principal place of business for an 44
order requiring the subpoenaed person to appear and testify and 45
to produce documents, reports, answers, records, accounts, or 46
other data as specified in the subpoena. 47
Section 2. This act shall t ake effect July 1, 2023. 48
