A bill to be entitled 1 
An act relating to law enforcement officer funeral 2 
service benefits; providing a short title; creating s. 3 
110.1205, F.S.; authorizing a certain number of hours 4 
of administrative leave be granted to certain members 5 
of a law enforcement agency for a specified purpose; 6 
authorizing the head of a law enforcement agency to 7 
deny such administrative leave under certain 8 
circumstances; amending s. 112.061, F.S.; authorizin g 9 
travel expenses to certain members of a law 10 
enforcement agency for a specified purpose; amending 11 
s. 287.17, F.S.; authorizing use of a state motor 12 
vehicle to attend the funeral of a law enforcement 13 
officer killed in the line of duty; amending s. 14 
112.19, F.S.; increasing the amount of money to be 15 
paid toward the funeral and burial expenses for 16 
certain officers killed in the line of duty; providing 17 
an effective date. 18

Be It Enacted by the Legislature of the State of Florida: 20 
 21 
 Section 1.  This act may be cited as the "Respecting their 22 
Sacrifice Act." 23 
 Section 2.  Section 110.1205, Florida Statutes, is created 24 
to read: 25

 110.1205  Administrative leave for law enforcement 26 
officers.—The head of a law enforcement agency may grant 27 
administrative leave, not to exceed 8 hours, to an employee of 28 
the law enforcement agency who is certified as a law enforcement 29 
officer under chapter 943 to attend the funeral service of a law 30 
enforcement officer killed in the line of duty. The head of the 31 
law enforcement agency m ay deny the use of administrative leave 32 
under this section in order to maintain minimum or adequate 33 
staffing requirements. 34 
 Section 3.  Paragraph (i) is added to subsection (3) of 35 
section 112.061, Florida Statutes, to read: 36 
 112.061  Per diem and travel expenses of public officers, 37 
employees, and authorized persons; statewide travel management 38 
system.— 39 
 (3)  AUTHORITY TO INCUR TRAVEL EXPENSES. — 40 
 (i)  The head of a law enforcement agency may authorize 41 
travel expenses for an employee of the law enforcement agency 42 
who is certified as law enforcement officers under chapter 943 43 
to attend the funeral service of a law enforcement officer 44 
killed in the line of duty. 45 
 Section 4.  Paragraph (b) of subsection (3) of section 46 
287.17, Florida Statutes, is amended to r ead: 47 
 287.17  Limitation on use of motor vehicles and aircraft. — 48 
 (3) 49 
 (b)  For motor vehicles used by a state employee whose 50

duties are those of a law enforcement officer, as defined in s. 51 
943.10, the term "official state business" is shall be construed 52 
to permit the use of the vehicle during normal duty hours to and 53 
from lunch or meal breaks and incidental stops for personal 54 
errands, but not substantial deviations from official state 55 
business, if such use is at the direction of or with the 56 
permission of the agency head. The use of such vehicle by a law 57 
enforcement officer to attend the funeral of a law enforcement 58 
officer killed in the line of duty is considered official state 59 
business and is authorized under this section. 60 
 Section 5.  Paragraph (f) of s ubsection (2) of section 61 
112.19, Florida Statutes, is amended to read: 62 
 112.19  Law enforcement, correctional, and correctional 63 
probation officers; death benefits. — 64 
 (2) 65 
 (f)  If a full-time law enforcement, correctional, or 66 
correctional probation officer who is certified pursuant to 67 
chapter 943 and employed by a state agency is killed in the line 68 
of duty while the officer is engaged in the performance of law 69 
enforcement duties or as a result of an assault against the 70 
officer under riot conditions: 71 
 1.  The sum of $10,000 $1,000 must be paid, as provided for 72 
in paragraph (d), toward the funeral and burial expenses of such 73 
officer. Such benefits are in addition to any other benefits to 74 
which employee beneficiaries and dependents are entitled under 75

the Workers' Compensation Law or any other state or federal 76 
statutes; and 77 
 2.  The officer's employing agency may pay up to $5,000 78 
directly toward the venue expenses associated with the funeral 79 
and burial services of such officer. 80 
 Section 6.  This act shall take e ffect July 1, 2023. 81
