CS/HB 535 2023 CODING: Words stricken are deletions; words underlined are additions. hb0535-01-c1 Page 1 of 4 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S A bill to be entitled 1 An act relating to law enforcement officer funeral 2 service benefits; providing a short title; creating s. 3 110.1205, F.S.; authorizing a certain number of hours 4 of administrative leave be granted to certain members 5 of a law enforcement agency for a specified purpose; 6 authorizing the head of a law enforcement agency to 7 deny such administrative leave under certain 8 circumstances; amending s. 112.061, F.S.; authorizin g 9 travel expenses for certain members of a law 10 enforcement agency for a specified purpose; amending 11 s. 112.19, F.S.; increasing the amount of money to be 12 paid toward the funeral and burial expenses of certain 13 officers killed in the line of duty; amending s . 14 287.17, F.S.; authorizing use of a state motor vehicle 15 to attend a funeral in the state of a law enforcement 16 officer killed in the line of duty; providing an 17 effective date. 18 19 Be It Enacted by the Legislature of the State of Florida: 20 21 Section 1. This act may be cited as the "Respecting Their 22 Sacrifice Act." 23 Section 2. Section 110.1205, Florida Statutes, is created 24 to read: 25 CS/HB 535 2023 CODING: Words stricken are deletions; words underlined are additions. hb0535-01-c1 Page 2 of 4 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S 110.1205 Administrative leave for law enforcement 26 officers.—The head of a law enforcement agency may grant 27 administrative leave, not to exceed 8 hours, to an employee of 28 the agency who is certified as a law enforcement officer under 29 chapter 943 to attend a funeral service within the state of a 30 law enforcement officer who was killed in the line of duty. The 31 head of the law enforcement agency may deny the use of 32 administrative leave under this section in order to maintain 33 minimum or adequate staffing requirements. 34 Section 3. Paragraph (i) is added to subsection (3) of 35 section 112.061, Florida Statutes, to read: 36 112.061 Per diem and travel expenses of public officers, 37 employees, and authorized persons; statewide travel management 38 system.— 39 (3) AUTHORITY TO INCUR TRAVEL EXPENSES. — 40 (i) The head of a law enforcement agency may authorize 41 travel expenses for an employee of th e agency who is certified 42 as a law enforcement officer under chapter 943 to attend a 43 funeral service within the state of a law enforcement officer 44 who was killed in the line of duty. 45 Section 4. Paragraph (f) of subsection (2) of section 46 112.19, Florida Statutes, is amended to read: 47 112.19 Law enforcement, correctional, and correctional 48 probation officers; death benefits. — 49 (2) 50 CS/HB 535 2023 CODING: Words stricken are deletions; words underlined are additions. hb0535-01-c1 Page 3 of 4 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S (f) If a full-time law enforcement, correctional, or 51 correctional probation officer who is certified pursuant to 52 chapter 943 and employed by a state agency is killed in the line 53 of duty while the officer is engaged in the performance of law 54 enforcement duties or as a result of an assault against the 55 officer under riot conditions: 56 1. The sum of $10,000 $1,000 must be paid, as provided for 57 in paragraph (d), toward the funeral and burial expenses of such 58 officer. Such benefits are in addition to any other benefits to 59 which employee beneficiaries and dependents are entitled under 60 the Workers' Compensation Law or any other state or federal 61 statutes; and 62 2. The officer's employing agency may pay up to $5,000 63 directly toward the venue expenses associated with the funeral 64 and burial services of such officer. 65 Section 5. Paragraph (c) is added to subsection (3) of 66 section 287.17, Florida Statutes, to read: 67 287.17 Limitation on use of motor vehicles and aircraft. — 68 (3) 69 (c) For motor vehicles used by a state employee whose 70 duties are those of a law enforcement officer, as defined in s. 71 943.10(1), the term "official state business " shall be construed 72 to permit the use of the vehicle to attend a funeral service 73 within the state of a law enforcement officer who was killed in 74 the line of duty if such use is at the direction of or with the 75 CS/HB 535 2023 CODING: Words stricken are deletions; words underlined are additions. hb0535-01-c1 Page 4 of 4 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S permission of the agency head. 76 Section 6. This act shall take effect July 1, 2023. 77
