CS/CS/HB 535 2023 CODING: Words stricken are deletions; words underlined are additions. hb0535-02-c2 Page 1 of 4 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S A bill to be entitled 1 An act relating to funeral service benefits for public 2 safety officers; providing a short title; amending s. 3 112.061, F.S.; authorizing travel expenses for certain 4 members of a law enforcement agency for a specified 5 purpose; amending s. 112.19, F.S.; increasing the 6 amount of money to be paid toward the funeral and 7 burial expenses of certain officers killed in the line 8 of duty; creating s. 112.1921, F.S.; auth orizing a 9 certain number of hours of administrative leave to be 10 granted to certain members of a law enforcement agency 11 for a specified purpose; authorizing the head of a law 12 enforcement agency to deny such administrative leave 13 under certain circumstances; amending s. 287.17, F.S.; 14 authorizing the use of a state motor vehicle to attend 15 a funeral within the state of a law enforcement 16 officer who was killed in the line of duty; providing 17 an effective date. 18 19 Be It Enacted by the Legislature of the State of Florida: 20 21 Section 1. This act may be cited as the "Respecting Their 22 Sacrifice Act." 23 Section 2. Paragraph (i) is added to subsection (3) of 24 section 112.061, Florida Statutes, to read: 25 CS/CS/HB 535 2023 CODING: Words stricken are deletions; words underlined are additions. hb0535-02-c2 Page 2 of 4 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S 112.061 Per diem and travel expenses of public officers, 26 employees, and authorized persons; statewide travel management 27 system.— 28 (3) AUTHORITY TO INCUR TRAVEL EXPENSES. — 29 (i) The head of a law enforcement agency may authorize 30 travel expenses for an employee of the agency whose duties are 31 those of a law enforcement officer, as defined in s. 943.10(1), 32 to attend a funeral service within the state of a law 33 enforcement officer who was killed in the line of duty. 34 Section 3. Paragraph (f) of subsection (2) of section 35 112.19, Florida Statutes, is amended to read: 36 112.19 Law enforcement, correctional, and correctional 37 probation officers; death benefits. — 38 (2) 39 (f) If a full-time law enforcement, correctional, or 40 correctional probation officer who is certified pursuant to 41 chapter 943 and employed by a state agency is k illed in the line 42 of duty while the officer is engaged in the performance of law 43 enforcement duties or as a result of an assault against the 44 officer under riot conditions: 45 1. The sum of $10,000 $1,000 must be paid, as provided for 46 in paragraph (d), towar d the funeral and burial expenses of such 47 officer. The officer's employing agency may pay up to $5,000 52 directly toward the venue expenses associated with the funeral 53 and burial services of such officer. 54 Section 4. Section 112.1921, Florida Statutes, is created 55 to read: 56 112.1921 Administrative leave for law e nforcement 57 officers.—The head of a law enforcement agency may grant 58 administrative leave, not to exceed 8 hours, to an employee of 59 the agency whose duties are those of a law enforcement officer, 60 as defined in s. 943.10(1), to attend a funeral service withi n 61 the state of a law enforcement officer who was killed in the 62 line of duty. The head of the law enforcement agency may deny 63 the use of administrative leave under this section in order to 64 maintain minimum or adequate staffing requirements. 65 Section 5. Paragraph (c) is added to subsection (3) of 66 section 287.17, Florida Statutes, to read: 67 287.17 Limitation on use of motor vehicles and aircraft. — 68 (3) 69 (c) For motor vehicles used by a state employee whose 70 duties are those of a law enforcement officer, a s defined in s. 71 943.10(1), the term "official state business" shall be construed 72 to permit the use of the vehicle to attend a funeral service 73 within the state of a law enforcement officer who was killed in 74 the line of duty if such use is at the direction o f or with the 75 CS/CS/HB 535 2023 CODING: Words stricken are deletions; words underlined are additions. hb0535-02-c2 Page 4 of 4 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S permission of the agency head. 76 Section 6. This act shall take effect October 1, 2023. 77
