Paragraph (c) of subsection (1) of section 14 320.08, Florida Statutes, is amended to read: 15 320.08 License taxes. —Except as otherwise provided herein, 16 there are hereby levied and imposed annual license taxes for the 17 operation of motor vehicles, mopeds, tri -vehicles as defined in 18 s. 316.003, and mobile homes as defined in s. 320.01, which 19 shall be paid to and collected by the department or its agent 20 upon the registration or renewal of registration of the 21 following: 22 (1) MOTORCYCLES AND MOPEDS. — 23 (c) Upon registration of a motorcycle, motor -driven cycle, 24 or moped, in addition to the license taxes specified in this 25 HB 709 2023 CODING: Words stricken are deletions; words underlined are additions. hb0709-00 Page 2 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S subsection, a nonrefundable motorcycle safet y education fee in 26 the amount of $2.50 shall be paid. The proceeds of such 27 additional fee shall be deposited in the Highway Safety 28 Operating Trust Fund and shall be distributed as follows: 29 1. One dollar shall be paid quarterly to ABATE of Florida, 30 Inc., a nonprofit corporation, to fund a grassroots motorcycle 31 driver improvement program consisting of activities administered 32 by ABATE of Florida, Inc., to increase awareness for all drivers 33 and motorcycle safety for motorcycle operators. ABATE of 34 Florida, Inc., may use pamphlets, outdoor advertising, and 35 personal contact with the public to enhance motorcycle awareness 36 and safety. ABATE of Florida, Inc., shall file an annual report 37 with the President of the Senate and the Speaker of the House of 38 Representatives outlining the types of activities ABATE of 39 Florida, Inc., conducted and stating the number of individuals 40 who had exposure to the materials. 41 2. The remaining $1.50 shall be used to fund a motorcycle 42 driver improvement program implemented pursuant to s. 322.025, 43 the Florida Motorcycle Safety Education Program established in 44 s. 322.0255, or the general operations of the department. 45 Section 2. Section 322.025, Florida Statutes, is amended 46 to read: 47 322.025 Driver improvement. —The department may impleme nt 48 programs to improve the driving ability of the drivers of this 49 state. Motorcycle driver improvement programs implemented 52 pursuant to this section or s. 322.0255 may be funded by the 53 portion of the motorcycle safety education fee collected 54 pursuant to s. 320.08(1)(c)2. s. 320.08(1)(c), which shall be 55 deposited in the Highway Safety Operating Trust Fund. 56 Section 3. This act sh all take effect July 1, 2023. 57
