Paragraph (c) of subsection (1) of section 14 320.08, Florida Statutes, is amended to read: 15 320.08 License taxes. —Except as otherwise provided herein, 16 there are hereby levied and imposed annual license taxes for the 17 operation of motor vehicles, mopeds, tri -vehicles as defined in 18 s. 316.003, and mobile homes as defined in s. 320.01, which 19 shall be paid to and collected by the department or its agent 20 upon the registration or renewal of registration of the 21 following: 22 (1) MOTORCYCLES AND MOPEDS. — 23 (c) Upon registration of a motorcycle, motor -driven cycle, 24 or moped, in addition to the license taxes specified in this 25 CS/HB 709 2023 CODING: Words stricken are deletions; words underlined are additions. hb0709-01-c1 Page 2 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S subsection, a nonrefundable motorcycle safety education fee in 26 the amount of $2.50 shall be paid. The proceeds of such 27 additional fee shall be deposited in the Highway Safety 28 Operating Trust Fund to fund a motorcycle driver improvement 29 program implemented pursuant to s. 322.025, the Florida 30 Motorcycle Safety Education Program established in s. 322.0255, 31 or the general operations of the department . 32 1. All proceeds from the motorcycle safety education fee 33 shall be used for one or more safety and education programs, 34 including the programs under ss. 322. 025 and 322.0255, which 35 shall be administered by the department or by a private entity 36 selected by the department which is focused primarily on 37 promoting motorcycle safety and education throughout this state. 38 2. Any such program shall promote motorcycle safety and 39 education for the purpose of reducing motorcycle injuries and 40 deaths in this state. The program may include, but is not 41 limited to, pamphlets, advertisements, public service 42 announcements, digital media, social media, a website, 43 participation in grassroots motorcycle events, advocacy, and 44 reasonable administrative expenses. 45 3. The department or the entity selected by the department 46 shall submit an annual report to the President of the Senate and 47 the Speaker of the House of Representatives outli ning the types 48 of events in which the department or entity participated, an 49 outline of the methods the department or entity selected to 50 CS/HB 709 2023 CODING: Words stricken are deletions; words underlined are additions. hb0709-01-c1 Page 3 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S distribute safety and education materials or expose the public 51 to awareness programs, and an estimate of the number of p ersons 52 who were exposed to the educational efforts of the department or 53 entity. 54 Section 2. This act shall take effect October 1, 2023. 55
