A bill to be entitled 1 
An act relating to intravenous vitamin treatment; 2 
providing a short title; creating s. 456.0302, F.S.; 3 
providing definitions; providing requirements for 4 
persons administering intravenous vitamin treatment; 5 
requiring the Board of Nursing, the Board of Medicine, 6 
and the Board of Osteopathic Medicine to adopt rules 7 
establishing procedures to administer intravenous 8 
vitamin treatment and emergency protocols; pr oviding 9 
penalties; providing an effective date. 10 
 11 
Be It Enacted by the Legislature of the State of Florida: 12 
 13 
 Section 1.  This act may be cited as the "Stephanie Balais 14 
Act." 15 
 Section 2.  Section 456.0302, Florida Statutes, is created 16 
to read: 17 
 456.0302  Administering intravenous vitamin treatment. — 18 
 (1)  As used in this section, the term: 19 
 (a)  "Health care provider" means a person licensed under 20 
chapter 458, chapter 459, or chapter 464. 21 
 (b)  "Intravenous vitamin treatment" means a procedure in 22 
which high concentrations of vitamins and minerals are 23 
administered directly into a person's bloodstream, allowing 24 
rapid absorption of higher doses of the vitamins and minerals 25

than if received through food or supplements. 26 
 (2)  A health care provider adminis tering intravenous 27 
vitamin treatment shall: 28 
 (a)  Obtain a complete self -screening risk assessment 29 
questionnaire from a patient before administering intravenous 30 
vitamin treatment. The health care provider must use a form 31 
adopted by rule by the applicable b oard. 32 
 (b)  Provide a patient with information related to 33 
potential side effects and risks of intravenous vitamin 34 
treatment and instructions on when to seek medical attention. 35 
 (c)  Provide a patient with a visit summary. 36 
 (d)  Notify a patient's designat ed physician that an 37 
intravenous vitamin treatment was administered. 38 
 (e)  Have a written plan for the provision of emergency 39 
care. A copy of the emergency plan must be kept at the location 40 
offering intravenous vitamin treatment. The plan must include 41 
the following: 42 
 1.  The name and address of the hospital closest to the 43 
location at which the intravenous vitamin treatment is being 44 
performed. 45 
 2.  Reasons for which an emergency transfer of a patient 46 
may be required. 47 
 3.  Medical services to be used in the e vent of a health 48 
emergency. 49 
 (3)  A health care provider may not administer intravenous 50

vitamin treatment to a patient if the provider determines that 51 
it is unsafe to administer such treatment based upon the results 52 
of the self-screening risk assessment qu estionnaire or 53 
otherwise. 54 
 (4)  The respective boards shall adopt rules establishing 55 
procedures to safely administer intravenous vitamin treatment 56 
and establish protocols to follow in the event of a health 57 
emergency, including, but not limited to, requirem ents for: 58 
 (a)  Education and training requirements for health care 59 
providers authorized to administer intravenous vitamin 60 
treatment. 61 
 (b)  Self-screening risk assessments. 62 
 (c)  Information that a health care provider must provide 63 
to a patient before admi nistering intravenous vitamin treatment. 64 
 (d)  Documentation regarding the process of administering 65 
intravenous vitamin treatment. 66 
 (e)  Notification that must be provided to a patient's 67 
designated physician if intravenous vitamin treatment is 68 
administered. 69 
 (f)  Evaluation and review of the administration practices 70 
used to administer intravenous vitamin treatment. 71 
 (5)  Violation of this section constitutes grounds for 72 
disciplinary action under this chapter and chapter 458, chapter 73 
459, or chapter 464, as applicable. 74 
 Section 3.  This act shall take effect July 1, 2023. 75
