Be It Enacted by the Legislature of the State of Florida: 6

Section 1. Paragraph (i) of subsection (1) of section 8
538.03, Florida Statutes, is amended to read: 9
538.03 Definitions; applicability. — 10
(1) As used in this part, the term: 11
(i) "Secondhand goods" means per sonal property previously 12
owned or used which is not regulated metals property regulated 13
under part II and which is purchased, consigned, or traded as 14
used property. The term includes gift certificates and credit 15
memos as defined in s. 501.95 which are pur chased, consigned, or 16
traded by a secondhand dealer. The term does not include office 17
furniture;, pianos;, books;, clothing;, organs;, money; coins, 18
motor vehicles;, costume jewelry; gold, silver, platinum, 19
palladium, or rhodium bullion that has been assay ed and is 20
properly marked as to its weight and fineness; , cardio and 21
strength training or conditioning equipment designed primarily 22
for indoor use;, and secondhand sports equipment that is not 23
permanently labeled with a serial number. As used in this 24
paragraph, the term "secondhand sports equipment" does not 25

include golf clubs. 26
Section 2. This act shall take effect July 1, 2023. 27
