only applies to individuals who are entitled to 4
receive the federal minimum wage under the federal 5
Fair Labor Standards Act, as amended; providing 6
applicability; providing an effective date. 7

Be It Enacted by the Legislature of the State of Florida: 9

Section 1. Subsection (3) of section 448.110, Florida 11
Statutes, is amended to read: 12
448.110 State minimum wage; annual wage adjustment; 13
enforcement.— 14
(3) Effective May 2, 2005, Employers shall pay employees a 15
minimum wage at an hourly rate of $6.15 for all hours worked in 16
Florida. Only those indi viduals entitled to receive the federal 17
minimum wage under the federal Fair Labor Standards Act , as 18
amended, and its implementing regulations shall be eligible to 19
receive the state minimum wage pursuant to s. 24, Art. X of the 20
State Constitution and this s ection. The provisions of ss. 213 21
and 214 of the federal Fair Labor Standards Act, as interpreted 22
by applicable federal regulations and implemented by the 23
Secretary of Labor, are incorporated herein. 24
Section 2. The amendments to s. 448.110, Florida Sta tutes, 25

in this act are intended to clarify existing law. 26
Section 3. This act shall take effect upon becoming a law. 27
