A bill to be entitled 1 
An act relating to age and licensure requirements for 2 
operation of a golf cart; amending s. 316.212, F.S.; 3 
prohibiting a person from operating a golf cart on 4 
certain roadways unless he or she possesses a valid 5 
learner's driver license or driver license; providing 6 
a penalty; amending s. 322.04, F.S.; conforming 7 
provisions to changes made by the act; providing an 8 
effective date. 9

Be It Enacted by the Legislat ure of the State of Florida: 11 
 12 
 Section 1.  Subsection (7) of section 316.212, Florida 13 
Statutes, is amended, and subsection (9) of that section is 14 
republished, to read: 15 
 316.212  Operation of golf carts on certain roadways. —The 16 
operation of a golf cart up on the public roads or streets of 17 
this state is prohibited except as provided herein: 18 
 (7)  A golf cart may not be operated on public roads or 19 
streets by a any person: 20 
 (a)  Who is under 16 years of age unless he or she 21 
possesses a valid learner's driver l icense that is not suspended 22 
or revoked.  23 
 (b)  Who is 16 years of age or older unless he or she 24 
possesses a valid learner's driver license or valid driver 25

license that is not suspended or revoked the age of 14. 26 
 (9)  A violation of this section is a noncr iminal traffic 27 
infraction, punishable pursuant to chapter 318 as a moving 28 
violation for infractions of subsections (1) -(5) or a local 29 
ordinance corresponding thereto and enacted pursuant to 30 
subsection (8), or punishable pursuant to chapter 318 as a 31 
nonmoving violation for infractions of subsection (6), 32 
subsection (7), or a local ordinance corresponding thereto and 33 
enacted pursuant to subsection (8). 34 
 Section 2.  Paragraph (e) of subsection (1) of section 35 
322.04, Florida Statutes, is amended to read: 36 
 322.04  Persons exempt from obtaining driver license. — 37 
 (1)  The following persons are exempt from obtaining a 38 
driver license: 39 
 (e)  Any person operating a golf cart, as defined in s. 40 
320.01, which is operated in accordance with the provisions of 41 
s. 316.212. 42 
 Section 3.  This act shall take effect July 1, 2023. 43
