Section 365.1755, Florida Statutes, is created 25 HB 983 2023 CODING: Words stricken are deletions; words underlined are additions. hb0983-00 Page 2 of 4 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S to read: 26 365.1755 Emergency telephone number; automatic location 27 identification; wireless providers. — 28 (1) As used in this section: 29 (a) "Account holder" means a person who is legally 30 responsible and who enters into an agreement with a wireless 31 telephone service provider for the purchase of a wireless 32 telephone. 33 (b) "Automatic location identification" means the 34 automatic display at the Public Safety Answering Point of the 35 caller's mobile telephone number, the address or location of the 36 wireless telephone, and supplementary emergency services 37 information. 38 (c) "Emergency" means a situation, physical condition, or 39 method of operation which presents imminent danger of death or 40 serious physical or mental harm to a person. 41 (d) "Family or household member" means spouses; former 42 spouses; persons related by blood or marriage; persons who are 43 presently residing together as if a family or who have resided 44 together in the past as if a family; and persons who are parents 45 of a child in common regardless of whether they have been 46 married. Except for persons who have a child in commo n, the 47 family or household members must be currently residing or have 48 in the past resided together in the same single dwelling unit. 49 (e) "Mobile telephone number" means the telephone number 50 HB 983 2023 CODING: Words stricken are deletions; words underlined are additions. hb0983-00 Page 3 of 4 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S assigned to a wireless telephone at the time of initial 51 activation. 52 (f) "Wireless services provider" means a person who 53 provides services using licensed or unlicensed spectrum, whether 54 at a fixed location or mobile, using wireless facilities. 55 (2) In the event of an actual or perceived emergency, a 56 wireless provider shall, immediately upon the request of an 57 account holder, provide automatic location identification of any 58 of the account holder's wireless telephones on their account. 59 (3) Automatic location identification services shall be 60 provided through a unique an d well-advertised emergency number 61 created by the wireless services provider. There shall be no 62 wait times for persons who call the emergency number and the 63 account holder shall not be placed on hold at any time. 64 (4) Any automatic location identification information 65 provided by the wireless provider shall be verbally provided and 66 graphically transmitted to the account holder's wireless 67 telephone he or she is calling from, regardless of whether the 68 automatic location identification service has been activat ed or 69 deactivated on the wireless telephone, except as provided in 70 section (5). 71 (5) A family or household member of an account holder who 72 uses the account holder's wireless telephone may contact the 73 wireless provider and request a temporary block, not to exceed 74 30 days, on the account holder's ability to be provided with 75 HB 983 2023 CODING: Words stricken are deletions; words underlined are additions. hb0983-00 Page 4 of 4 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S automatic location identification services or information. The 76 request shall be confidential and may not be provided to the 77 account holder. 78 (6) A wireless provider may charge a fee for automatic 79 location identification services at no more than $5 per request. 80 Section 2. This act shall take effect July 1, 2023. 81
