HB 1291 2023 CODING: Words stricken are deletions; words underlined are additions. hb1291-00 Page 1 of 2 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S A bill to be entitled 1 An act relating to flood zone disclosures for dwelling 2 units; creating s. 83.505, F.S.; requiring landlords 3 or persons authorized to enter into rental agreements 4 on behalf of landlords to make specified disclosures 5 relating to flood zones before the commencement of a 6 tenancy; requiring landlords to notify current tenants 7 of a change in a dwelling unit's flood zone 8 designation; providing an effective date. 9 10 Be It Enacted by the Legislature of the State of Florida: 11 12 Section 1. Section 83.505, Florida Statutes, is created to 13 read: 14 83.505 Disclosure of flood zone. —A landlord, or a person 15 authorized to enter into a rental agreement on the landlord's 16 behalf, must disclose in writing to a tenant before the 17 commencement of a tenancy whether the dwelling unit is located 18 within a flood zone established by the Federal Emergency 19 Management Agency. If the dwelling unit is located within a 20 flood zone, such disclosure mu st also include a list of all 21 previous flood-related damages to the dwelling unit and include 22 the risk designation for the flood zone and definition of the 23 designation as determined by the Federal Emergency Management 24 Agency. This act shall take effect July 1, 2023. 29
