An act relating to specialty contractors; amending s. 2 
489.113, F.S.; requiring the Construction Industry 3 
Licensing Board to establish certified specialty 4 
contractor categories for voluntary licensure by a 5 
specified date; amending s. 489.117, F.S.; prohibiting 6 
local governments from imposing new licensing 7 
requirements for certain specialty contractors; 8 
providing an effective date. 9

Be It Enacted by the L egislature of the State of Florida: 11 
 12 
 Section 1.  Subsection (6) of section 489.113, Florida 13 
Statutes, is amended to read: 14 
 489.113  Qualifications for practice; restrictions. — 15 
 (6)(a) The board shall, by rule, designate those types of 16 
specialty contractors which may be certified under this part. 17 
The limit of the scope of work and responsibility of a specialty 18 
contractor shall be established by the board by rule. However, a 19 
certified specialty contractor category established by board 20 
rule exists as a vol untary statewide licensing category and does 21 
not create a mandatory licensing requirement. Any mandatory 22 
statewide construction contracting licensure requirement may 23 
only be established through specific statutory provision. 24 
 (b)  By July 1, 2023, the board shall, by rule, establish 25

certified specialty contractor categories for voluntary 26 
licensure for all of the following: 27 
 1.  Structural aluminum or screen enclosures. 28 
 2.  Marine seawall work. 29 
 3.  Marine bulkhead work. 30 
 4.  Marine dock work. 31 
 5.  Marine pile driving. 32 
 6.  Structural masonry. 33 
 7.  Structural prestressed, precast concrete work. 34 
 8.  Rooftop solar heating installation. 35 
 9.  Structural steel. 36 
 10.  Window and door installation, including garage door 37 
installation and hurricane or windstorm protection. 38 
 Section 2.  Paragraph (a) of subsection (4) of section 39 
489.117, Florida Statutes, is amended to read: 40 
 489.117  Registration; specialty contractors. — 41 
 (4)(a)1. A person whose job scope does not substantially 42 
correspond to either the job sco pe of one of the contractor 43 
categories defined in s. 489.105(3)(a) -(o), or the job scope of 44 
one of the certified specialty contractor categories established 45 
by board rule, is not required to register with the board. A 46 
local government, as defined in s. 163 .211, may not require a 47 
person to obtain a license , issued by the local government or 48 
the state, for a job scope which does not substantially 49 
correspond to the job scope of one of the contractor categories 50

defined in s. 489.105(3)(a) -(o) and (q) or authori zed in s. 51 
489.1455(1), or the job scope of one of the certified specialty 52 
contractor categories established pursuant to s. 489.113(6). A 53 
local government may not require a license as a prerequisite to 54 
submit a bid for public work projects if the work to be 55 
performed does not require a license under general law . 56 
 2. For purposes of this section, job scopes for which a 57 
local government may not require a license include, but are not 58 
limited to, painting; flooring; cabinetry; interior remodeling; 59 
driveway or tennis court installation; handyman services; 60 
decorative stone, tile, marble, granite, or terrazzo 61 
installation; plastering; stuccoing; caulking; and canvas awning 62 
and ornamental iron installation. A local government may not 63 
require a license to obtain a pe rmit for such job scopes. 64 
 Section 3.  This act shall take effect July 1, 2023. 65
