Florida Senate - 2023 SB 370 By Senator Brodeur 10-00722-23 2023370__ 1 A bill to be entitled 2 An act relating to electronic motor vehicle 3 registration certificates; amending s. 320.0605, F.S.; 4 authorizing a uniform paper or electronic format of 5 the registration certificate for a motor vehicle; 6 prohibiting an officer or agent from accessing certain 7 information upon presentation of an electronic 8 registration certificate on an electronic device; 9 making technical changes; providing an effective date. 10 11 Be It Enacted by the Legislature of the State of Florida: 12 13 Section 1.Section 320.0605, Florida Statutes, is amended 14 to read: 15 320.0605Certificate of registration and other documents; 16 possession required; exception. 17 (1)(a)The registration certificate in a uniform paper or 18 electronic format, as prescribed by the department, or an 19 official copy thereof;, a true copy or an electronic copy of 20 rental or lease documentation issued for a motor vehicle or 21 issued for a replacement vehicle in the same registration 22 period;, a temporary receipt printed upon self-initiated 23 electronic renewal of a registration via the Internet;, or a cab 24 card issued for a vehicle registered under the International 25 Registration Plan must shall, at all times while the vehicle is 26 being used or operated on the roads of this state, be in the 27 possession of the operator thereof or be carried in the vehicle 28 for which such documentation was issued at all times while the 29 vehicle is being used or operated on the roads of this state and 30 must shall be exhibited upon demand of any authorized law 31 enforcement officer or any agent of the department, except for a 32 vehicle registered under s. 320.0657. This subsection section 33 does not apply during the first 30 days after purchase of a 34 replacement vehicle. A violation of this subsection section is a 35 noncriminal traffic infraction, punishable as a nonmoving 36 violation as provided in chapter 318. 37 (b)1.The act of presenting to a law enforcement officer or 38 agent of the department an electronic device displaying an 39 electronic registration certificate or a copy of rental or lease 40 documentation does not constitute consent for the officer or 41 agent to access any information on the device other than the 42 displayed rental or lease documentation. 43 2.The person who presents the device to the officer or 44 agent assumes the liability for any resulting damage to the 45 device. 46 (2)Rental or lease documentation that is sufficient to 47 satisfy the requirement in subsection (1) includes the 48 following: 49 (a)Date and time of rental; 50 (b)Rental agreement number; 51 (c)Rental vehicle identification number; 52 (d)Rental vehicle license plate number and state of 53 registration; 54 (e)Vehicles make, model, and color; 55 (f)Vehicles mileage; and 56 (g)Authorized renters name. 57 Section 2.This act shall take effect January 1, 2024.
