Florida Senate - 2023 SB 528 By Senator Davis 5-01068-23 2023528__ 1 A bill to be entitled 2 An act relating to gain-time for attempted sexual 3 offenses; amending s. 944.275, F.S.; eliminating the 4 possibility of gain-time for persons convicted of 5 attempting specified offenses; providing an effective 6 date. 7 8 Be It Enacted by the Legislature of the State of Florida: 9 10 Section 1.Paragraph (e) of subsection (4) of section 11 944.275, Florida Statutes, is amended to read: 12 944.275Gain-time. 13 (4) 14 (e)Notwithstanding subparagraph (b)3., 15 1.For sentences imposed for offenses committed on or after 16 October 1, 2014, and before July 1, 2023, the department may not 17 grant incentive gain-time if the offense is a violation of s. 18 782.04(1)(a)2.c.; s. 787.01(3)(a)2. or 3.; s. 787.02(3)(a)2. or 19 3.; s. 794.011, excluding s. 794.011(10); s. 800.04; s. 20 825.1025; or s. 847.0135(5). 21 2.For sentences imposed for offenses committed on or after 22 July 1, 2023, the department may not grant incentive gain-time 23 if the offense is a violation or an attempted violation of s. 24 782.04(1)(a)2.c.; s. 787.01(3)(a)2. or 3.; s. 787.02(3)(a)2. or 25 3.; s. 794.011, excluding s. 794.011(10); s. 800.04; s. 26 825.1025; or s. 847.0135(5). 27 Section 2.This act shall take effect July 1, 2023.
