Florida Senate - 2023 SB 648 By Senator Collins 14-00701-23 2023648__ 1 A bill to be entitled 2 An act relating to trespassing; amending s. 810.011, 3 F.S.; redefining the term posted land to include 4 land classified as agricultural which has no 5 trespassing signs placed at specified points; 6 providing an effective date. 7 8 Be It Enacted by the Legislature of the State of Florida: 9 10 Section 1.Paragraph (a) of subsection (5) of section 11 810.011, Florida Statutes, is amended to read: 12 810.011Definitions.As used in this chapter: 13 (5)(a)Posted land is that land upon which any of the 14 following signs or notices are placed: 15 1.Signs are placed not more than 500 feet apart along, and 16 at each corner of, the boundaries of the land or, for land 17 classified as agricultural pursuant to s. 193.461, signs placed 18 at each point of ingress and at each corner of the boundaries of 19 the agricultural land which, upon which signs there appears 20 prominently display, in letters of not less than 2 inches in 21 height, the words No Trespassing and in addition thereto the 22 name of the owner, lessee, or occupant of the said land. The 23 Said signs must shall be placed along the boundary line of 24 posted land in a manner and in such position as to be clearly 25 noticeable from outside the boundary line; or 26 2.a.A conspicuous no trespassing notice is painted on 27 trees or posts on the property, provided that the notice is: 28 (I)Painted in an international orange color and displaying 29 the stenciled words No Trespassing in letters no less than 2 30 inches high and 1 inch wide either vertically or horizontally; 31 (II)Placed so that the bottom of the painted notice is not 32 less than 3 feet from the ground or more than 5 feet from the 33 ground; and 34 (III)Placed at locations that are readily visible to any 35 person approaching the property and no more than 500 feet apart 36 on agricultural land. 37 b.When a landowner uses the painted no trespassing posting 38 to identify a no trespassing no trespassing area, those 39 painted notices must shall be accompanied by signs complying 40 with subparagraph 1. and placed conspicuously at all places 41 where entry to the property is normally expected or known to 42 occur. 43 Section 2.This act shall take effect July 1, 2023.
