property; amending s. 810.09, F.S.; providing enhanced 3
criminal penalties for trespass with specified intent 4
on certain commercial agricultural property; providing 5
a definition; providing an effective date. 6

Be It Enacted by the Legislature of the State of Florida: 8

Section 1. Paragraph (k) is added to subsection (2) of 10
section 810.09, Florida Statutes, to read: 11
810.09 Trespass on property other than structure or 12
conveyance.— 13

(k)1. The offender commits a felony of the third degree, 15
punishable as provided in s. 775.082, s. 775.083, or s. 775.084 , 16
if the offender trespasses with the intent to commit a crime on 17
commercial agricultural property that is legally posted and 18
identified by signs in letters of at least 2 inches at each 19
pedestrian and vehicle entrance in substantially the following 20
manner: "THIS AREA IS A DESIGNATED COMMERCIAL AGRICULTURAL 21
PROPERTY AND ANYONE WHO TRESPASSES ON THIS PROPERTY COMMITS A 22
FELONY." 23
2. For purposes of this paragraph, the term "commercial 24
agricultural property" means property that is cleared of its 25

natural vegetation or fenced for the purposes of planting, 26
growing, harvesting, processing, or storing plant or animal 27
commercial commodities intended for human consumption. 28
Section 2. This act shall take effect July 1, 2024. 29
