A bill to be entitled 1 
An act relating to college campus facilities in areas 2 
of critical state concern; amending s. 1013.40, F.S.; 3 
revising the number of beds certain Florida College 4 
System institutions may provide to certain persons; 5 
authorizing such beds to be provided to health care 6 
workers; revising which funds may not be used for 7 
construction of dormitories; providing an effective 8 
date. 9

Be It Enacted by the Legislature of t he State of Florida: 11 
 12 
 Section 1.  Subsection (4) of section 1013.40, Florida 13 
Statutes, is amended to read: 14 
 1013.40  Planning and construction of Florida College 15 
System institution facilities; property acquisition. — 16 
 (4)  The campus of a Florida College System institution 17 
within a municipality designated as an area of critical state 18 
concern, as defined in s. 380.05, and having a comprehensive 19 
plan and land development regulations containing a building 20 
permit allocation system that limits annual growth, m ay 21 
construct dormitories for up to 340 beds for Florida College 22 
System institution students, and an additional 50 25 beds for 23 
employees, educators, health care workers, and first responders. 24 
Such dormitories are exempt from the building permit allocation 25

system and may be constructed up to 60 feet in height if the 26 
dormitories are otherwise consistent with the comprehensive 27 
plan, the Florida College System institution has a hurricane 28 
evacuation plan that requires all dormitory occupants to be 29 
evacuated 48 hours in advance of tropical storm-force force 30 
winds, and transportation is provided for dormitory occupants 31 
during an evacuation. State appropriations funds and tuition and 32 
fee revenues may not be used for construction, debt service 33 
payments, maintenance, o r operation of such dormitories. 34 
Additional dormitory beds constructed after July 1, 2016, may 35 
not be financed through the issuance of bonds by the Florida 36 
College System institution; however, bonds may be issued by 37 
nonpublic entities as part of a public -private partnership 38 
between the college and a nonpublic entity. 39 
 Section 2.  This act shall take effect July 1, 2024. 40
